Automated Facial Recognition Systems (AFRS): Responding to Related Privacy Concerns

The Supreme Court of India, in Puttaswamy I recognized that the right to privacy is not surrendered merely because the individual is in a public place. Privacy is linked to the individual as it is an essential facet of human dignity. Justice Chelameswar further clarified that privacy is contextual. Even in a public setting, people trying to converse in whispers would signal a claim to the right to privacy. Speaking on a loudspeaker would naturally not signal the same claim.

The Supreme Court of Canada has also affirmed the notion of contextual privacy. As recently as on 7 March, 2019, the Supreme Court of Canada in a landmark decision defined privacy rights in public areas implicitly applying Helena Nissenbaum’s theory of contextual integrity. Helena Nissenbaum explains that the extent to which the right to privacy is eroded in public spaces with the help of her theory of contextual integrity.

Nissenbaum suggests that labelling information as exclusively public or private fails to take into account the context which rationalises the desire of the individual to exercise her privacy in public. To explain this with an illustration, there exists a reasonable expectation of privacy in the restroom of a restaurant, even though it is in a public space.

In R v Jarvis (Jarvis), the Court overruled a Court of Appeal for Ontario decision to hold that people can have a reasonable expectation of privacy even in public spaces. In this case, Jarvis was charged with the offence of voyeurism for secretly recording his students. The primary issue that the Supreme Court of Canada was concerned with was whether the students filmed by Mr. Jarvis enjoyed a reasonable expectation of privacy at their school.

The Court in this case unanimously held that students did indeed have a reasonable expectation of privacy. The Court concluded nine contextual factors relevant in determining whether a person has a reasonable expectation to privacy would arise. The listed factors were:

“1. The location the person was in when he or she was observed or recorded,

2. The nature of the impugned conduct (whether it consisted of observation or recording),

3. Awareness of or consent to potential observation or recording,

4. The manner in which the observation or recording was done,

5. The subject matter or content of the observation or recording,

6. Any rules, regulations or policies that governed the observation or recording in question,

7. The relationship between the person who was observed or recorded and the person who did the observing or recording,

8. The purpose for which the observation or recording was done, and

9. The personal attributes of the person who was observed or recorded.” (paragraph 29 of the judgement).

The Court emphasized that the factors are not an exhaustive list, but rather were meant to be a guiding tool in determining whether a reasonable expectation of privacy existed in a given context. It is not necessary that each of these factors is present in a given situation to give rise to an expectation of privacy.

Compared to the above-mentioned factors in Jarvis, the Indian Supreme Court in Justice K.S Puttaswamy (Retd.) v. Union of India: Justice Sikri (Puttaswamy II) — the case which upheld the constitutionality of the Aadhaar project relied on the following factors to determine a reasonable expectation of privacy in a given context:

“(i) What is the context in which a privacy claim is set up?

(ii) Does the claim relate to private or family life, or a confidential relationship?

(iii) Is the claim a serious one or is it trivial?

(iv) Is the disclosure likely to result in any serious or significant injury and the nature and extent of disclosure?

(v) Is disclosure relates to personal and sensitive information of an identified person?

(vi) Does disclosure relate to information already disclosed publicly? If so, its implication?”

These factors (acknowledged in Puttaswamy II in paragraph 292) seem to be very similar to the ones laid down in Jarvis, i.e., there is a strong reliance on the context in both cases. While there is no explicit mention of individual attributes of the individual claiming a reasonable expectation, the holding that children should be given an opt out indicates that the Court implicitly takes into account personal attributes (e.g. age) as well.

The Court in Jarvis further (in paragraph 39) took the example of a woman in a communal change room at a public pool. She may expect other users to incidentally observe her undress but she would continue to expect only other women in the change room to observe her and reserve her rights against the general public. She would also expect not to be video recorded or photographed while undressing, both from other users of the pool and by the general public.

If it is later found out that the change room had a one-way glass which allowed the pool staff to view the users change — or if there was a concealed camera recording persons while they were changing, she could claim a breach of her reasonable expectation of privacy under such circumstances and it would constitute an invasion of privacy.

So, in the context of an AFRS, an individual walking down a public road may still signal that they wish to avail of their right to privacy. In such contexts, a concerted surveillance mechanism may come up against constitutional roadblocks.

What is the nature of information being collected?

The second big question — the nature of information which is being collected plays a role in determining the extent to which a person can exercise their reasonable expectation of privacy. Puttaswamy II laid down that collection of core biometric information such as fingerprints, iris scans in the context of the Aadhaar-Based Biometric Authentication (‘ABBA’) is constitutionally permissible. The basis of this conclusion is that the Aadhaar Act does not deal with the individual’s intimate or private sphere.

The judgement of the Supreme Court in Puttaswamy II is in a very specific context (i.e. the ABBA). It does not explain or identify the contextual factors which determine the extent to which privacy may be reasonably expected over biometrics generally. In this judgment, the Court observed that demographic information and photographs do not raise a reasonable expectation of privacy under Article 21 unless there exist special circumstances such as the disclosure of juveniles in conflict of law or a rape victim’s identity.

Most importantly, the Court held that face photographs for the purpose of identification are not covered by a reasonable expectation of privacy. The Court distinguished face photographs from intimate photographs or those photographs which concern confidential situations.

Face photographs, according to the Court, are shared by individuals in the ordinary course of conduct for the purpose of obtaining a driving license, voter id, passport, examination admit cards, employment cards, and so on. Face photographs by themselves reveal no information.

Naturally, this pronouncement of the Apex Court is a huge boost for the introduction of AFRS in India.

Abroad, however, on 4 September 2019, in Edward Bridges v. Chief Constable of South Wales Police, a Division Bench of the High Court in England and Wales heard a challenge against an AFRS introduced by law enforcement (see Endnote 1). The High Court rejected a claim for judicial review holding that the AFRS in question does not violate inter alia the right to privacy under Article 8 of the European Convention of Human Rights (‘ECHR’).

According to the Court, the AFRS was used for specific and limited purposes, i.e., only when the image of the public matched a person on an existing watchlist. The use of the AFRS was therefore considered a lawful and fair restriction.

The Court, however, acknowledged that extracting biometric data through AFRS is “well beyond the expected and unsurprising”. This seems to be a departure from the Indian Supreme Court’s observation in Puttaswamy II that there is no reasonable expectation of privacy over biometric data in the context of ABBA, and may be a wiser approach for the Indian courts to adopt.

Highlights for August 2019
The Oxford Internet Institute and CIS are creating a State of the Internet’s Languages report, as baseline research with both numbers and stories, to demonstrate how far we are from making the internet multilingual. The call is available in Arabic, Brazilian Portuguese, English, IsiZulu, Spanish, and Tamil. CIS invites friends and communities to translate the call into other languages. CIS's Access to Knowledge (A2K) team is conducting a free knowledge movement and as part of this initiative it is inviting contributions from the Wikipedia community. Photos, media, content or archives donated by community members would be used worldwide to disseminate information. The content you are donating must be under Creative Commons Share-like content. You must have the copyright of the content under CC licenses. Over the last few years, several digital identity schemes have been initiated in different countries across the world. There has been significant momentum on digital ID, especially after the adoption of UN Sustainable Development Goal 16.9, which calls for legal identity for all by 2030. Authors, Amber Sinha and Pooja Saxena, explore about the uses and design of digital identity systems and ask two core questions a) What are appropriate uses of ID?, and b) How should we think about the technological design of ID? Together with the Institute of Technology & Society (ITS), Brazil, and the Centre for Intellectual Property and Information Technology Law(CIPIT), Kenya, CIS participated at a side event in RightsCon 2019 held in Tunisia, titled Holding ID Issuers Accountable, What Works?, organised by the Omidyar Network. A report of the event is published here. As governments across the globe implement new, foundational, digital identification systems (“Digital ID”), or modernize existing ID programs, there is dire need for greater research and discussion about appropriate uses of Digital ID systems. At RightsCon 2019 in Tunis, we presented working drafts on appropriate use of Digital ID by the partner organisations of this three-region research alliance - ITS from Brazil, CIPIT from Kenya, and CIS from India. CIS gave its comments to the ID4D Practitioners’ Guide: Draft For Consultation released by ID4D in June, 2019. The submission is divided into three main parts. The first part (General Comments) contains the high-level comments on the Practitioners’ Guide, while the second part (Specific Comments) addresses individual sections in the Guide. The third and final part (Additional Comments) does not relate to particulars in the Practitioners' Guide but other documents that it relies upon. The Ministry of Health and Family Welfare had released the National Digital Health Blueprint on 15 July 2019 for comments. CIS submitted its comments. CIS notes that the nature of data which would be subject to processing in the proposed digital framework pre-supposes a robust data protection regime in India, one which is currently absent. Accordingly, it urges the ministry to cease the implementation of the framework until the Personal Data Protection Bill is passed by the Parliament. Aayush Rathi , Vedika Pareek , Divij Joshi and Pranav Bidare co-authored a research paper 'Future of Work in the ASEAN'. The authors reveal that the future of work will be mediated through region and country specific factors such as socioeconomic,geopolitical and demographic change. The report was edited by Elonnai Hickok and Ambika Tandon with research assistance by Sankalp Srivastava and Anjanaa Aravindan. The research is supported by Tides Foundation.

Highlights

India houses the second largest population in the world at approximately 1.35 billion individuals. In such a diverse and dense context, law enforcement could be a challenging job. Elonnai Hickok and Vipul Kharbanda throw light on the CLOUD Act and its implifications for India in a blog post.
On August 9, 2018, the DNA Technology (Use and Application) Regulation Bill, 2018 was introduced in the Lok Sabha. CIS had commented on some key aspects of the bill in many forums earlier. Elonnai Hickok and Murali Neelakantan in an article published by Bloomberg Quint have voiced their opinion on the bill.
Murali Neelakantan, Swaraj Barooah, Swagam Dasgupta and Torsha Sarkar in an Op-ed in Bloomberg Quint have examined the National Health Stack, an ambitious attempt by the government to to build a digital infrastructure with a “deep understanding of the incentive structures prevalent in the Indian healthcare ecosystem. The authors have argued that collection of health data, without sensitisation and accountability, has the potential to deny healthcare to the vulnerable.
An article titled India's Contribution to Internet Governance Debates, co-authored by Sunil Abraham, Mukta Batra, Geetha Hariharan, Swaraj Barooah and Akriti Bopanna, was published in the NLUD Student Law Journal, an annual peer-reviewed journal published by the National Law University, Delhi.
IT/IT-eS Sector and the Future of Work in India was organized at Omidyar Networks’ office in Bangalore, on June 29, 2018. Torsha Sarkar, Ambika Tandon and Aayush Rath co-authored a report.
Swaraj Barooah and Gurshabad Grover co-authored an article in Livemint that examines a few problematic provisions in the proposed Anti-trafficking Bill. The authors say that it may lead to censorship.
The Researchers at Work programme of CIS had invited abstracts for essays that explore dimensions of offline lives. Selected authors are expected to submit the first draft of the essay (2000-4000 words) by Friday, October 5, 2018.

The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of its research on privacy and free speech, CIS is engaged with two different projects. The first one (under a grant from Privacy International and IDRC) is on surveillance and freedom of expression (SAFEGUARDS). Highlights
Elonnai Hickok wrote a blog post which provided a high level comparison of the 2017 and 2015 DNA Profiling Bill - calling out positive changes, remaining issues, and missing provisions. Rohini Lakshane wrote a blog post on dataset for patent requirements and complex products. The dataset has been released under the Creative Commons-Attribution-Share Alike 4.0 License. A Marathi Wikipedia workshop was held in Sangli, Maharashtra. Subodh Kulkarni shared the developments in a blog post. In an emphatic endorsement of the right to privacy, a nine judge constitutional bench unanimously upheld a fundamental right to privacy. The events leading to this bench began during the hearings in the ongoing Aadhaar case, when in August 2015, Mukul Rohatgi, the then Attorney General stated that there is no constitutionally guaranteed right to privacy. CIS gave its statement on right to privacy judgment.

Highlights

Researchers at Work programme has published a book titled Digital Activism in Asia Reader exploring in detail digital activism in Asia. The Reader was edited by Nishant Shah, P.P. Sneha, and Sumandro Chattapadhyay with support from Anirudh Sridhar, Denisse Albornoz, and Verena Getahun. The pre-publication drafts of two sections written by Sumandro Chattapadhyay for the third volume (2000-2010) of the Asia Internet History series edited by Prof. Kilnam Chon have been posted for open-review process. As part of the 'Studying Internets in India' series, RAW published blog entries on Governing Speech on the Internet and Mock-Calling - Ironies of Outsourcing and the Aspirations of an Individual. NVDA team conducted a workshop at Jeevan Jyoti School for the Blind, Varanasi from August 26 to 28, 2015. Eighty five students and 13 teachers took part in the training programme. NVDA team had conducted another workshop earlier in Nashik. The workshop was conducted in June. A batch of 17 Special Educators and teachers of the blind attended the workshop. Maggie Huang, Arpita Sengupta and Paavni Anand as part of the Pervasive Technologies project co-authored a research paper that seeks to compare the publicly available information on the websites of music collective management organizations ("CMOs") operating within India, the United States, and the United Kingdom. Amulya Purushothama, Nehaa Chaudhari and Varun Baliga in a blog entry have delved into the question of what the mandate of the Sectoral Innovation Council is, what its activities are, and what vision for IPR development in India has it put forth. An RTI Application has been filed by CIS to attain information on these issues. In a blog post, Amulya Purushothama announced our new MHRD IPR Chair Series and has charted the sequence of events, starting from the establishment of MHRD IPR Chairs, to discussions surrounding their purpose and functioning, to concerns surrounding the lack of information about the IPR Chairs, the first round of RTIs that CIS had filed in regard to this and the responses it solicited. Subhashish Panigrahi interviewed Prateek Pattanaik. Prateek has not just digitized as many as 54 Odia-language poetry dating early 18th century but has also annotated, both poetic and prosaic translation in his blogs "Sri Jagannatha" and "Utkal Sangeet". He has also published a complete book "Kisora chandranana champu" on Odia Wikisource. A recent entrant into the Odia Wikimedia community, Prateek is also the youngest Odia Wikimedian. Rohan George and Elonnai Hickok in a blog post analyzed consent, big data and data protection that examines in detail why the principle of consent is providing us increasingly less of an aegis in protecting our data. Elonnai Hickok, Vipul Kharbanda and Vanya Rakesh on behalf of CIS submitted a clause-by-clause comments on the Human DNA Profiling Bill that was circulated by the Department of Biotechnology on June 9, 2015. Sunil Abraham, Elonnai Hickok and Tarun Krishnakumar co-authored an article titled Security: Privacy, Transparency and Technology. The article was published by Observer Research Foundation, Digital Debates 2015: CyFy Journal Volume 2. Elonnai Hickok in a blog post titled A Review of the Policy Debate around Big Data and Internet of Things has done an analysis as to how regulators and experts across jurisdictions are reacting to Big Data and Internet of Things. The Supreme Court of India has deemed it fit to refer the question of the very existence of a fundamental right to privacy to a Constitution Bench to finally decide the matter, and define the contours of such right if it does exist. Vipul Kharbanda analyses this in a blog entry. Experts and regulators across jurisdictions are examining the impact of Big Data practices on traditional data protection standards and principles. This will be a useful and pertinent exercise for India to undertake as the government and the private and public sectors begin to incorporate and rely on the use of Big Data in decision making processes and organizational operations. Elonnai Hickok has provided an initial evaluation of how Big Data could impact India's current data protection standards. Elonnai Hickok has provided a comparison of Human DNA Profiling Bill 2012 vs. the Human DNA Profiling Bill 2015, CIS's main recommendations vs. the 2015 Bill, Sub-Committee Recommendations vs. the 2015 Bill, and the Expert Committee Recommendations vs. the 2015 Bill. CIS submitted its comments to the non-paper on the UNGA Overall Review of the Implementation of the WSIS outcomes, evaluating the progress made and challenges ahead. In a policy brief, Vipul Kharbanda has analyzed the different laws regulating surveillance at the state and central level in India and calls out ways in which the provisions are unharmonized. The brief then provides recommendations for the harmonization of surveillance law in India. Hardnews interviewed Sunil Abraham about the future of the internet in India. The article was published in their August edition. Shyam Ponappa in an Op-ed published by Business Standard has given an analysis on the reasons of the number of dropped calls on our mobile phones.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing a project on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here. The project on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India got over and the compilation has been printed.

Highlights

CIS published a policy guide on Privacy in Healthcare that seeks to understand the legal regulations governing data flow in the health sector - particularly hospitals, and how these regulations are implemented.
Nehaa Chaudhari wrote two articles on the Karnataka Goondas Act in Spicy IP. The first one is an overview on the various provisions of the law and discusses the potential impact of the amendment . The second one is a note on legislative competence .

Andhra Loyola College and CIS entered into a memorandum of understanding (MoU) to steward the growth of Telugu Wikipedia and to make available free knowledge in Telugu to all Telugus across the globe.
In July 2014, the Department of Biotechnology and the Department of Science, Ministry of Science and Technology, Government of India released a draft Open Access Policy. CIS participated in discussions along with experts brought on board by the Drafting Committee to develop and review the open access policy. As a follow-up, CIS prepared comments to the draft Policy .

Anandini K. Rathore wrote a report on the second privacy and surveillance roundtable held in New Delhi at the India International Centre on July 4, 2014.
As part of its project on mapping cyber security experts in Asia with funding from Citizen's Lab, CIS interviewed Tibetan monkGyanak Tsering and Saumil Shah, security expert.

Published a white paper on content removal best practices and put it up for feedback. The draft paper has been created to frame the discussion towards the creation of a set of principles for intermediary liability in consultation with groups of Internet-focused NGOs and the academic community.
Shyam Ponappa's monthly column Transformation, or Drift? published in Business Standard and Organizing India Blogspot was mirrored on the CIS website.
P.P. Sneha blogged on the emergence of the phenomenon of the alt-academy in the West and the nuances and possibilities of such a space in the Indian context .

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The updated draft is being reviewed by the Office of the Chief Commissioner for Persons with Disabilities. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

Analysing Latest List of Blocked Sites (Communalism & Rioting Edition) (by Pranesh Prakash): Pranesh Prakash did a preliminary analysis on a leaked list of the websites blocked from August 18, 2012 till August 21, 2012 by the Indian government. There were a total of 309 specific items (those being URLs, Twitter accounts, img tags, blog posts, blogs, and a handful of websites) that were blocked. While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Both require effective and efficient use of networks and resources, including spectrum:

Building Knowledge and Capacity around Telecommunication Policy in India

Ford Foundation has given a grant of USD 2,00,000 to CIS to build expertise in the area of telecommunications in India. The knowledge repository deals with these modules: Introduction to Telecommunications, Telecommunications Infrastructure and Technologies, Government of India Regulatory Framework for Telecom, Telecommunication and the Market, Universal Access and Accessibility, The International Telecommunications Union and other international bodies, Broadcasting, Emerging Topics and Way Forward. Dr. Surendra Pal, Satya N Gupta, Paranjoy Guha Thakurta, Payal Malik, Dr. Rakesh Mehrotra and Dr. Nadeem Akhtar are the expert reviewers.

The following are the new outputs:

Auctioning and Allocation of Spectrum (by Snehashish Ghosh): Auction of spectrums was introduced in the telecommunication market after the failure of the administrative process of allocating spectrum. Auctions use a price mechanism to allocate spectrum. Auction of spectrum can be used to increase efficiency and earn maximum revenue.
The Telecom Regulatory Authority of India Act, 1997 (by Snehashish Ghosh): The main objective of the TRAI Act was to establish the TRAI and the Telecom Dispute Settlement Appellate Tribunal. Snehashish also touches upon the amendment to the TRAI Act, government control over TRAI, scheme of the TRAI Act, constitution of TRAI, its powers and functions, grounds and procedures for appeal to the tribunal, etc.

National Telecom Policy, 2012 (by Snehashish Ghosh): The National Telecom Policy, 2012 was approved by the Union Cabinet on May 31, 2012. Snehashish tells us about the vision of the National Telecom Policy, 2012, its background, the strategies (broadband rural telephony and universal service obligation fund), licensing, convergence and value-added services, spectrum management, etc.
New Telecom Policy, 1999 (by Snehashish Ghosh): The New Telecom Policy, 1999 was formulated on the basis of the report of Group on Telecommunication. In this unit, Snehashish talks about the objectives of the Policy, its targets, the new category of service providers, role of the regulator, other mandates to the Policy, amendment to the New Telecom Policy, 1999, etc.
National Telecom Policy, 1994 (by Snehashish Ghosh): The National Telecom Policy, 1994 was formulated for the purpose of opening up the Indian markets for foreign direct investment as well as domestic investment in the telecom sector. Snehashish throws light on the objectives of the National Telecom Policy, 1994, the status of telecom services prior to the implementation of the aforesaid Policy; value added services, hardware and technological aspects, basic services, and outcomes of the National Telecom Policy.

Consumers International IP Watchlist 2012 — India Report (by Pranesh Prakash): The India Report for Consumers International IP Watchlist 2012 was published on the A2K Network website. According to the report, India's Copyright Act is a relatively balanced instrument that recognises the interests of consumers through its broad private use exception, and by facilitating the compulsory licensing of works that would otherwise be unavailable. However, the compulsory licensing provision have not been utilized so far, because of both a lack of knowledge and more importantly because of the stringent conditions attached to them.

Copyright Law: More Than a Moral Obligation (by Jaya Bhattacharji Rose, Businessworld, August 9, 2012): “So far, things have worked well because sepia-tinted photographs have generally become part of the public domain. But now, only photographs by photographers who died before 1951 are part of the public domain. Ring Side View: Update on WIPO Negotiations on the Treaty for the Visually Impaired (by Rahul Cherian): As the negotiations between Member States progressed it became clear that the United States and the European Union were blocking the Treaty while everybody else was pushing hard for the Treaty. Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by CIS and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and Internet technologies, in emerging information societies. Consolidating knowledge from Asia, Africa and Latin America, it builds a global network of knowledge partners who want to critically engage with the dominant discourse on youth, technology and social change, in order to look at the alternative practices and ideas in the Global South. It also aims at building new ecologies that amplify and augment the interventions and actions of the digitally young as they shape our futures.

Accessibility

Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

Although there may not be one centralized authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” Its latest endeavour has resulted into these:

Public Lecture

The Mirror in the Enigma: How Germany lost World War II to a Mathematical Theorem (Rohit Gupta gave a lecture at CIS on August 12, 2011).

CIS is doing a project, ‘Privacy in Asia’. It is funded by Privacy International (PI), UK and the International Development Research Centre, Canada and is being administered in collaboration with the Society and Action Group, Gurgaon. The two-year project commenced on 24 March 2010 and will be completed as agreed to by the stakeholders. It was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around challenges and violations of privacy in India. In furtherance of these goals it aims to draft and promote over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

Political is as Political does
The Talking Back workshop has been an extraordinary experience for me. The questions that I posed for others attending the workshop have hounded me as they went through the course of discussion, analysis and dissection. Strange nuances have emerged, certain presumptions have been questioned, new legacies have been discovered, novel ideas are still playing ping-pong in my mind, and a strange restless excitement – the kind that keeps me awake till dawning morn – has taken over me, as I try and figure out the wherefore and howfore of things. I began the research project on Digital Natives in a condition of not knowing, almost two years ago. Since then, I have taken many detours, rambled on strange paths, discovered unknown territories and reached a mile-stone where I still don’t know, but don’t know what I don’t know, and that is a good beginning.

When rogue politicians and bureaucrats are granted unrestricted access to information then the very future of democracy and free media will be in jeopardy. In an article published in the Pune Mirror on 10 August,
2010, Sunil Abraham examines this in light of the BlackBerry-to-BlackBerry messenger service that the Government of India plans to block if its makers do not allow the monitoring of messages. He says that civil society should rather resist and insist on suitable checks and balances like governmental transparency and a fair judicial oversight instead of allowing the government to intrude into the privacy

Civil Liberties and the amended Information Technology Act, 2000
This post examines certain limitations of the Information Technology Act, 2000 (as amended in 2008). Malavika Jayaram points out the fact that when most countries of the world are adopting plain English instead of the conventional legal terminology for better understanding, India seems to be stuck in the old-fashioned method thereby, struggling to maintain a balance between clarity and flexibility in drafting its laws. The present Act, she says, is although an improvement over the old Act and seeks to address and improve on certain areas in the right direction but still comes up short in making necessary changes when it comes to fundamental rights and personal liberties. The new Act retains elements from the previous one making it an abnormal document and this could have been averted if there had been some attention to detail.

Attempted data breach of UIDAI, RBI, ISRO and Flipkart is worrisome

Perhaps, we got lucky this time, but the ongoing problem of massive cyber-security breaches wouldn't stop at one thwarted attempt to steal sensitive information from the biggest and most important databases.

This was published by DailyO on October 4, 2017.

An alarming report on a potential data breach impacting almost 6,000 Indian organisations — including the Unique Identification Authority of India (UIDAI) that hosts Aadhaar numbers, Reserve Bank of India, Bombay Stock Exchange and Flipkart — has surfaced and supposedly been contained.

A cyber security firm in Pune, Seqrite, had found in its Cyber Intelligence Labs that India's national internet registry, IRINN (Indian Registry for Internet Names and Numbers), which comes under NIXI (National Internet Exchange of India), was compromised, though the issue has reportedly been "addressed".

Sequite tracked an advertisement on the "dark net" — the digital underworld — offering access to servers and database dump of more than 6,000 Indian businesses and public assets, including the big ones such as UIDAI, RBI, BSE and Flipkart.

The report states that the "dealer could have had access to usernames, email ids, passwords, organisation name, invoices and billing documents, and few more important fields, and could have potentially shut down an entire organisation".

The UIDAI has denied the security breach of Aadhaar data in the IRINN attacks, in an expected move. "UIDAI reiterated that its existing security controls and protocols are robust and capable of countering any such attempts or malicious designs of data breach or hacking," said the report, which is basically a rebuttal from the powerful organisation at the heart of centralising all digital information of all Indians.

Though the aggrieved parties have been notified, and the NCIIPC (National Critical Information Infrastructure Protection Centre) is looking at the issue, what this means is that digital information is a minefield susceptible to all kinds of threats from criminals as well as foreign adversaries, along with being commercially exploited by major conglomerates.

Till August 2017 alone, around 37 incidents of ransomware attacks have been reported, including the notorious WannaCry attacks. But what makes the attacks very, very threatening is the government's insistence — illegal at that — to link Aadhaar with every service, and create a centralised nodal, superior network of all networks.

This "map of maps" has been rightly called out as a potential national security threat, as it makes a huge reservoir of data vulnerable to cyberthreats from mercenaries, the digital underworld and foreign adversaries.

That the data dump in the digital black market provides access to entire servers for a meagre sum of Rs 42 lakh, as mentioned in the report, is a sign of how insecure our personal information could be on the servers of the biggest government organisations and commercial/online retail giants. This includes the likes of Flipkart, which store our passwords, emails, phone numbers and other important information linked to our bank details and more.

Whilst UIDAI was declared a "protected system" under Section 70 of the Information Technology Act, and a critical information infrastructure, in practice, there are way too many breaches and leaks of Aadhaar data to merit that tag.

Because the current (officially thwarted) attempt to hack into these nodal databases involved the data of hundreds of millions of Indians, the matter has been dealt with the required seriousness. However, as the report states, "among the companies whose emails they found were Tata Consultancy Services, Wipro, Indian Space Research Organisation, Mastercard/Visa, Spectranet, Hathway, IDBI Bank and EY".

This is a laundry list of the biggest and most significant organisations, with massive digital footprints, which are sitting on enormous databanks. Hacking into ISRO, for example, could pose a formidable risk to India's space programmes as well as jeopardise information safety of crucial space projects that are jointly conducted with friendly countries such as Russia, China and the US.

A widely circulated report prepared by the Centre for Internet and Society (CIS) on the Aadhaar Act and its non-compliance with data protection law in India underlined the major flaws in the 2016 Aadhaar Act, that makes it vulnerable to several digital threats.

Moreover, CIS also reported how government websites, especially "those run by National Social Assistance Programme under Ministry of Rural Development, National Rural Employment Guarantee Act (NREGA) run by Ministry of Rural Development, Daily Online Payment Reports under NREGA (Governemnt of Andhra Pradesh) and Chandranna Bima Scheme (also run by Government of Andhra Pradesh) combined were responsible for publicly exposing personal and Aadhaar details of over 13 crore citizens".

The government has been rather lackadaisical about the grave security threats posed by India's shaky digital infrastructure, saying it's robust when it's not: the UIDAI itself has been brushing the allegations of exclusion, data breach and leaking of data from various government and private operators' servers and there have been several documentations of the security threat as well as the human rights violations that the digital breaches pose for India's institutions and its citizens.

As noted welfare economist Jean Dreze says, "With Aadhaar immensely reinforcing the government's power to reward loyalty and marginalise dissenters, the embers of democracy are likely to be further smothered."

Even as India's jurisprudence held privacy and autonomy as supreme, Indians remain vulnerable to institutional failures and an abject lack of awareness on the gravity of digital destabilisation.

At the Heart of Crypto Investing, There is Tether. But Will its Promise Pan Out?

The $18.5 million fine levied by the New York attorney general’s office earlier this year to settle a legal dispute, raises more questions than answers.

Cryptocurrencies have become the centerpiece of the global digital zeitgeist in 2021. Anyone remotely familiar with them would probably be able to name a few of the famous ones like Bitcoin and Ethereum.

However, there exists a lesser known cryptocurrency at the heart of this $ 3 trillion market, Tether. Issued by the company Tether.ltd, Tether forms the foundation for modern day crypto trading and could potentially be one of the biggest schemes in financial history.

Tether is a special type of cryptocurrency known as a stablecoin. Unlike coins such as Bitcoin and Ethereum, Tether’s monetary value is not a function of the forces of the crypto market but is rather pegged to the US Dollar. What this means is that 1 Tether will always be worth exactly 1 USD. This fixed value has allowed it to occupy a unique position within the crypto ecosphere, with it becoming the de facto standard of liquidity within these markets by acting as a widely accepted substitute to the US dollar.

At present, buying cryptocurrency using traditional fiat money (like dollars or rupees) comes with certain challenges. Purchasing with traditional currencies requires the use of banking services that come with a host of fees and time delays. At the same time, purchasing one type of crypto coin like Bitcoin with another coin like Ethereum can prove difficult due to the constantly shifting values of both coins. This is where Tether comes in. Acting as a bridge between the traditional financial world and the crypto market, it has become a sort of digital dollar — one that makes cryptocurrency trading significantly easier.

The problem with tether

On the surface, Tether seems like a perfectly reasonable innovation that looks to fill in the gaps that exist within the market. Dig a little deeper than the surface and the discrepancies start to appear.

The premise of Tether’s appeal comes from its value being pegged to the US dollar. The company initially claimed to have achieved this by ensuring that their currency was “fully backed” by cash reserves.

The process looked something like this: You gave the company 1 US dollar and they gave you 1 Tether that you could use to make other crypto purchases. If you returned your Tether, you would get your dollar back and the Tether you returned would be ‘burned’ (removed from circulation). This meant that for every Tether that existed the company would have 1 corresponding dollar in reserve in the bank, ensuring that the currency was backed.

However, there was an enormous flaw in this system. Since Tether.ltd was the sole creator of the coin, it could create as many of them as it wanted while falsely claiming that these new Tethers were also backed fully by cash reserves. And this is exactly what is alleged to have happened in a case brought forward against Tether.ltd by the New York Attorney General’s office. The filings made by the attorney general noted that in their investigation they found that not only did the company have inadequate reserves to back the number of Tethers in circulation, but that there were significant periods of time wherein the company did not have any bank accounts or any access to banking at all — thereby exposing Tethers claims of being backed as being demonstrably false.

The scam was alleged to have worked as follows. First, the company would issue new coins that were not actually backed by any corresponding dollars. These new Tethers were then transferred to Bitfinex – a cryptocurrency exchange that was owned by Tether.ltd. These unbacked Tethers would then be used to buy bitcoin, with the momentum from this increased demand causing the price of bitcoin to rise. They would then exchange their newly appreciated bitcoins for actual US dollars — thereby essentially creating real money where none had previously existed. While there is no conclusive evidence for this being true, research has pointed to increased tether supply causing a boom in bitcoin prices in 2017.

The company has since altered its claim from being backed by cash reserves, to now being backed by a number of assets (which it refers to as its ‘reserves’) – of which cash only formed a small subset. It maintains that the cumulative value of their assets does equal the number of Tethers in circulation, though it is worth noting that the veracity of these claims has been consistently challenged.

How does this affect the rest of the crypto market?

Tether’s problems are unfortunately not limited to itself, but rather affect the entire crypto marketplace. If the New York Attorney General’s filings are true, then it would mean that a significant amount of the demand in the crypto market could potentially not be backed by any actual purchasing power and that the price of cryptocurrencies like bitcoin have been artificially inflated.

If Tether was ever found (either by a regulatory body or through leaks) to have been creating unbacked units of its currency then it would result in a significant amount of buying pressure disappearing from the crypto market. And since Tether isn’t just any other cryptocurrency but rather is a medium for exchange in the crypto world, its downfall would have severe knock on effects that could cause a serious crash in the entire crypto market.

Quantifying such knock-on effects would be extremely difficult, however as previously mentioned, research has clearly outlined a significant causal relationship between tether’s supply and increased bitcoin prices. This leads to the conclusion that the reverse would likely be true; that a rapid decrease in tethers would cause a significant decrease in the price of bitcoin and other cryptocurrencies.

Ultimately, no one knows for sure whether Tether is a scheme or not. However, mounting evidence from a number of independent sources have all pointed to discrepancies in the company’s functioning. What is clear is that, if the allegations are in fact true, then Tether poses a serious risk to the entire crypto marketplace and investors.

The Meeting started with the Chairman of the Meeting Shri Shashi Mal, Co-Chairman, ASSOCHAM IT/ITes Council & Director & Industry Leader, IBM India welcoming the Members present.

Mr. Mal introduced the topic of discussion and its importance in the present context.

Mr. Mal pointed out that internet has touched every aspect of life and has significant stake in almost every business in the present times.

He further pointed out two main points, how internet can be managed and how do you legally govern the activities going on the internet. He suggested approaching all interest groups for their views before we make the recommendations.

He emphasized that the consensus has to be build within the stakeholders of the subject and informed that for this ASSOCHAM is planning to organize INDIA INTERNET GOVERNANCE SUMMIT (IIGS)-2015 on 26^th March, 2015 in New Delhi.

Mr. T. V. Ramachandran, Chairman, ASSOCHAM National Council on Telecommunications said that there are many opinions within the stakeholders. He said that India, with maximum numbers of users has the right to be heard in the international forums. He further said that Industry should have an active participation in the policy making.

Mr. Vikram Tiwathia, COAI asked why ASSOCHAM is organizing this program and who has mandated them to do so and why they want to send the recommendations to the Government.

It was informed that ASSOCHAM has already announced in the Ministry of External Affairs Meeting and the National Security Council Secretariat that ASSOCHAM will be creating a forum where all the stakeholders could present their point of view and proceedings of this Summit will be shared with the Government as the Recommendations.

Mr. Vikram Tiwathia to this replied that there are many stakeholders like civil society, academia, but ASSOCHAM should present the view of the Industry only.

Mr. Mal suggested that there might be different views within the Industry on Internet Governance.

Mr. Tiwathia informed the Members present that Department of Electronics and IT, Government of India has constituted a Multistakeholder Advisory Group (MAG) for the India Internet Governance Forum but had met only twice. He suggested taking MAG outside the Deity to a more autonomous body. He also suggested that India should sign the Budapest Convention (or what are the obstacles in signing the Budapest Convention).

One of the Members present suggested coming up with commercially accepted views for Internet Growth usage and Protection of Investors along with steps for Principle for Self Regulations.

One of the Members also brought out the Hygine Part of the Internet ie how internet is being used today.

It was decided that the following major issues in the Internet Governance will be discussed with Political, Technical & Economic aspects.

The Asian Regional Consultation on the WSIS+10 Review was held in Pattaya, Thailand from September 3 to 5, 2015. The event was organized by The Internet Democracy Project, Bytes for All, APNIC, the Association for Progressive Communications, ISOC, Global Partners Digital and ICT Watch. Jyoti Panday participated in the meeting.

The Asian Regional Consultation on the WSIS+10 Review brought together experts from different backgrounds and from around the Asian region who were concerned about issues concerning ICTs, sustainable development, human rights and Internet governance, to ask: what are the issues that our governments need to squarely address in the process of the review?

The meeting was conceived as a highly interactive working meeting that was geared towards producing a joint submission to the next input round on the Review outcome document.

This year's Asian Forum is scheduled to take place from November 10 - 19, 2013 in New Delhi, India. The nomination and application process commences from March 15 and the last date for submission of applications is June 1, 2013.

The Asian Forum on Global Governance will take a close look at the Asian region and at the challenges facing the global community. The primary objective of this forum is to provide an instructional and networking platform for young professional leaders to discuss, debate and challenge conventional interpretations of the existing complex realities confronting communities and leaders. The program provides a unique opportunity for them to confer with high-ranking figures from the political, business and academic communities from around the globe, and especially from Asia.

Though the emphasis is on Asia, there will be a fair mix of young leaders from Europe, Americas, Africa, Asia and Australia. The participants will be drawn from diverse sectors and streams of study. Each of these participants will, at the outset, be nominated by senior figures – Heads of Governments, Ministries and Government Departments, the CEO’s of major National and Multinational Companies, Heads of Universities and of Non-Profit Organizations – and thereafter carefully selected by an eminent jury of experts.

Long before the Mughals came to Delhi, the only territory which was inhabited was Qila Rai Pithora in what is now South Delhi. Excavations have found evidence of settlements at the site. The city had 13 gates, of which only some signs of three—Hauz Rani, Barka and Badaun-- have been found so far. The Badaun gate has been mentioned by the famous traveller Ibn Batuta and could have been the main entrance to the city. We will explore the ruins of the old fort built by Prithviraj Chauhan, climbing the crumbling ramparts and fort walls to get a panoramic view of the forest surroundings.
