Copyright Amendment Bill

Analysis of the Copyright (Amendment) Bill 2012
Pranesh Prakash
There are some welcome provisions in the Copyright (Amendment) Bill 2012, and some worrisome provisions. Pranesh Prakash examines five positive changes, four negative ones, and notes the several missed opportunities. The larger concern, though, is that many important issues have not been addressed by these amendments, and how copyright policy is made without evidence and often out of touch with contemporary realities of the digital era. Op-ed in Indian Express

Copyright Madness (Lawrence Liang and Achal Prabhala, Indian Express, May 22, 2012): India’s Copyright Act allows owners of content the right to prevent infringement through the use of injunctions, but these injunctions have to be narrowly construed and applied only to specific instances of infringement. This is to say, take down the infringing video, not the whole website, and don’t intimidate the host. When injunctions threaten freedom of speech and expression, then free speech should necessarily trump copyright claims — and the courts cannot be used as convenient shopping forums for maladies that don’t exist.

Cancel the Subscription (Prof. Subbiah Arunachalam, Indian Express, May 8, 2012): It has been a slow but steady move to make scholarship freely available... In India, though, there appears to be very little enthusiasm among the leaders of the science establishment. Neither the office of the principal scientific adviser nor the department of science and technology seems to have shown any interest in mandating open access to taxpayer-funded research. The National Knowledge Commission has recommended mandating open access to all publicly funded research, but it is not clear who will implement the recommendation. Right now, it is left to individuals to promote open access in India.

Design!PubliC — Third Conclave in New Delhi (National Museum, New Delhi, April 20, 2012): The event was organized by the Center for Knowledge Societies in collaboration with IBM, the Bill and Melinda Gates Foundation, Google and the Centre for Internet and Society. Sunil Abraham was a panelist and spoke in the session on Participation, Collaboration and Innovation.

Google Policy Fellowship

Google Policy Fellowship Programme: Call for Applications: CIS is inviting applications for the Google Policy Fellowship programme. Google is providing a USD 7,500 stipend to the India Fellow, who will be selected by August 15, 2012. The focus areas for the present fellowship programme include Access to Knowledge, Openness in India, Freedom of Expression, Privacy, and Telecom. The duration of the fellowship will be for about ten weeks starting from August 2012 upto October 2012. CIS will select the India Fellow. Send in your applications for the position by June 27, 2012.

We Are All Cyborgs (Nishant Shah, Indian Express, April 29, 2012): The cyborg reminds us that who we are as human beings is very closely linked with the technologies we use.

Citizen Action

Resisting Revolutions: Questioning the Radical Potential of Citizen Action (Nishant Shah, Development, Volume 55, Issue 2, May 2012): In this peer reviewed journal article, Nishant Shah looks into the radical claims and potentials of citizen action that have emerged in the last few years. He seeks to show how citizen action is not necessarily a radical form of politics and that we need to make a distinction between Resistances and Revolutions. It locates resistance as an endemic condition of governmentality within a State–Citizen–Market relationship and shows how it often strengthens the status quo rather than radically undermining it. He examines a campaign against corruption in India to see how the dissonance between the claims of the future and the practices of the present is produced in citizen action.

Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. One aspect is more extensive rural coverage and the other is a countrywide access to broadband which is low. Both require effective and efficient use of networks and resources, including spectrum:

Course

Building Knowledge and Capacity around Telecommunication Policy in India: Ford Foundation has given a grant of $200,000 to CIS to build expertise in the area of telecommunications in India over a period of two years. The project involves creating a repository comprising information about telecommunications related issues and policies and online course materials designed for a multi-stakeholder audience, organising interactive public lectures and workshops around the country to disseminate information on telecom issues and using traditional and new forms of media to disseminate information to academia, civil society, policy makers and the general public.

The Awesome Contracts Project (Geekup @ CIS, May 18, 2012): CIS co-organised the event with Has Geek. Vivek Durai, co-founder at Awesome Contracts gave a public lecture. Amith Narayan participated through Skype.

About CIS

CIS was registered as a society in Bangalore in 2008. As an independent, non-profit research organisation, it runs different policy research programmes such as Accessibility, Access to Knowledge, Openness, Internet Governance, and Telecom. Over the last four years our policy research programmes have resulted in outputs such as the e-Accessibility Policy Handbook for Persons with Disabilities with ITU and G3ict, and Digital Alternatives with a Cause?, Thinkathon Position Papers and the Digital Natives with a Cause? CIS is an accredited NGO at WIPO and has given policy briefs to delegations from various countries, our Programme Manager, Nirmita Narasimhan won the National Award for Empowerment of Persons with Disabilities from the Government of India and also received the NIVH Excellence Award.

Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by CIS and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and Internet technologies, in emerging information societies. Consolidating knowledge from Asia, Africa and Latin America, it builds a global network of knowledge partners who want to critically engage with the dominant discourse on youth, technology and social change, in order to look at the alternative practices and ideas in the Global South. It also aims at building new ecologies that amplify and augment the interventions and actions of the digitally young as they shape our futures.

Accessibility

Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

Internet Governance

Although there may not be one centralized authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” Its latest endeavour has resulted into these:

CDT Provides Answers to Questions on Internet Neutrality

CIS is doing a project, ‘Privacy in Asia’. It is funded by Privacy International (PI), UK and the International Development Research Centre, Canada and is being administered in collaboration with the Society and Action Group, Gurgaon. The two-year project commenced on 24 March 2010 and will be completed as agreed to by the stakeholders. It was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around challenges and violations of privacy in India. In furtherance of these goals it aims to draft and promote over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

Telecom

The growth in telecommunications in India has been impressive. While the potential for growth and returns exist, a range of issues need to be addressed for this potential to be realized. One aspect is more extensive rural coverage and the second aspect is a countrywide access to broadband which is low at about eight million subscriptions. Both require effective and efficient use of networks and resources, including spectrum. It is imperative to resolve these issues in the common interest of users and service providers. Mastering the Art of Keeping Indians Under Surveillance

In its first year in office, the National Democratic Alliance government has been notably silent on the large-scale surveillance projects it has inherited. This ended last week amidst reports the government is hastening to complete the Central Monitoring System (CMS) within the year.

In a statement to the Rajya Sabha in 2009, Gurudas Kamat, the erstwhile United Progressive Alliance’s junior communications minister, said the CMS was a project to enable direct state access to all communications on mobile phones, landlines, and the Internet in India. He meant the government was building ‘backdoors’, or capitalising on existing ones, to enable state authorities to intercept any communication at will, besides collecting large amounts of metadata, without having to rely on private communications carriers.

This is not new. Legally sanctioned backdoors have existed in Europe and the USA since the early 1990s to enable direct state interception of private communications. But the laws of those countries also subject state surveillance to a strong regime of state accountability, individual freedoms, and privacy. This regime may not be completely robust, as Edward Snowden’s revelations have shown, but at least it exists on paper. The CMS is not illegal by itself, but it is coloured by the compromised foundation of Indian surveillance law upon which it is built.

Surveillance and social control

The CMS is a technological project. But technology does not exist in isolation; it is contextualised by law, society, politics, and history. Surveillance and the CMS must be seen in the same contexts.

The great sociologist Max Weber claimed the modern state could not exist without monopolising violence. It seems clear the state also entertains the equal desire to monopolise communications technologies. The state has historically shaped the way in which information is transmitted, received, and intercepted. From the telegraph and radio to telephones and the Internet, the state has constantly endeavoured to control communications technologies.

Law is the vehicle of this control. When the first telegraph line was laid down in India, its implications for social control were instantly realised; so the law swiftly responded by creating a state monopoly over the telegraph. The telegraph played a significant role in thwarting the Revolt of 1857, even as Indians attempted to destroy the line; so the state consolidated its control over the technology to obviate future contests.

This controlling impulse was exercised over radio and telephones, which are also government monopolies, and is expressed through the state’s surveillance prerogative. On the other hand, because of its open and decentralised architecture, the Internet presents the single greatest threat to the state’s communications monopoly and dilutes its ability to control society.

Interception in India

The power to intercept communications arises with the regulation of telegraphy. The first two laws governing telegraphs, in 1854 and 1860, granted the government powers to take possession of telegraphs “on the occurrence of any public emergency”. In 1876, the third telegraph law expanded this threshold to include “the interest of public safety”. These are vague phrases and their interpretation was deliberately left to the government’s discretion.

This unclear formulation was replicated in the Indian Telegraph Act of 1885, the fourth law on the subject, which is currently in force today. The 1885 law included a specific power to wiretap. Incredibly, this colonial surveillance provision survived untouched for 87 years even as countries across the world balanced their surveillance powers with democratic safeguards.

The Indian Constitution requires all deprivations of free speech to conform to any of nine grounds listed in Article 19(2). Public emergencies and public safety are not listed. So Indira Gandhi amended the wiretapping provision in 1972 to insert five grounds copied from Article 19(2). However, the original unclear language on public emergencies and public safety remained.

Indira Gandhi’s amendment was ironic because one year earlier she had overseen the enactment of the Defence and Internal Security of India Act, 1971 (DISA), which gave the government fresh powers to wiretap. These powers were not subject to even the minimal protections of the Telegraph Act. When the Emergency was imposed in 1975, Gandhi’s government bypassed her earlier amendment and, through the DISA Rules, instituted the most intensive period of surveillance in Indian history.

Although DISA was repealed, the tradition of having parallel surveillance powers for fictitious emergencies continues to flourish. Wiretapping powers are also found in the Maharashtra Control of Organised Crime Act, 1999 which has been copied by Karnataka, Andhra Pradesh, Arunachal Pradesh, and Gujarat.

Procedural weaknesses

Meanwhile, the Telegraph Act with its 1972 amendment continued to weather criticism through the 1980s. The wiretapping power was largely exercised free of procedural safeguards such as the requirements to exhaust other less intrusive means of investigation, minimise information collection, limit the sharing of information, ensure accountability, and others.

This changed in 1996 when the Supreme Court, on a challenge brought by PUCL, ordered the government to create a minimally fair procedure. The government fell in line in 1999, and a new rule, 419A, was put into the Indian Telegraph Rules, 1951.

Unlike the United States, where a wiretap can only be ordered by a judge when she decides the state has legally made its case for the requested interception, an Indian wiretap is sanctioned by a bureaucrat or police officer. Unlike the United Kingdom, which also grants wiretapping powers to bureaucrats but subjects them to two additional safeguards including an independent auditor and a judicial tribunal, an Indian wiretap is only reviewed by a committee of the original bureaucrat’s colleagues. Unlike most of the world which restricts this power to grave crime or serious security needs, an Indian wiretap can even be obtained by the income tax department.

Rule 419A certainly creates procedure, but it lacks crucial safeguards that impugn its credibility. Worse, the contours of rule 419A were copied in 2009 to create flawed procedures to intercept the content of Internet communications and collect metadata. Unlike rule 419A, these new rules issued under sections 69(2) and 69B(3) of the Information Technology Act 2000 have not been constitutionally scrutinised.

Three steps to tap

Despite its monopoly, the state does not own the infrastructure of telephones. It is dependent on telecommunications carriers to physically perform the wiretap. Indian wiretaps take place in three steps: a bureaucrat authorises the wiretap; a law enforcement officer serves the authorisation on a carrier; and, the carrier performs the tap and returns the information to the law enforcement officer.

There are many moving parts in this process, and so there are leaks. Some leaks are cynically motivated such as Amar Singh’s lewd conversations in 2011. But others serve a public purpose: Niira Radia’s conversations were allegedly leaked by a whistleblower to reveal serious governmental culpability. Ironically, leaks have created accountability where the law has failed.

The CMS will prevent leaks by installing servers on the transmission infrastructure of carriers to divert communications to regional monitoring centres. Regional centres, in turn, will relay communications to a centralised monitoring centre where they will be analysed, mined, and stored. Carriers will no longer perform wiretaps; and, since this obviates their costs of compliance, they are willing participants.

In its annual report of 2012, the Centre for the Development of Telematics (C-DOT), a state-owned R&D centre tasked with designing and creating the CMS, claimed the system would intercept 3G video, ILD, SMS, and ISDN PRI communications made through landlines or mobile phones – both GSM and CDMA.

There are unclear reports of an expansion to intercept Internet data, such as emails and browsing details, as well as instant messaging services; but these remain unconfirmed. There is also a potential overlap with another secretive Internet surveillance programme being developed by the Defence R&D Organisation called NETRA, no details of which are public.

Culmination of surveillance

In its present state, Indian surveillance law is unable to bear the weight of the CMS project, and must be vastly strengthened to protect privacy and accountability before the state is given direct access to communications.

But there is a larger way to understand the CMS in the context of Indian surveillance. Christopher Bayly, the noted colonial historian, writes that when the British set about establishing a surveillance apparatus in colonised India, they came up against an established system of indigenous intelligence gathering. Colonial rule was at its most vulnerable at this point of intersection between foreign surveillance and indigenous knowledge, and the meeting of the two was riven by suspicion. So the colonial state simply co-opted the interface by creating institutions to acquire local knowledge.

The CMS is also an attempt to co-opt the interface between government and the purveyors of communications; because if the state cannot control communications, it cannot control society. Seen in this light, the CMS represents the natural culmination of the progression of Indian surveillance. No challenge against it that does not question the construction of the modern Indian state will be successful.

Masking personal data to protect privacy crucial for India, say experts

Using the concept of de-identification to protect an individual’s right to privacy and creating laws that constantly re-evaluates the difference between harmful and good use of data is crucial for India, according to an expert panel on data privacy.

That could mean developing a token system that lets the Unique Identification Authority of India (UIDAI) hold a master-list of data through Aadhaar, while generating token numbers for all other Know Your Customer (KYC) requirements, suggested the panel at the Global Technology Summit hosted by think-tank Carnegie India.

“If we can implement de-identification principles in government collection and storage of data, even if that data is displayed on the website it cannot be correlated to an individual. And if it can’t be correlated to an individual then immediately that data is not as dangerous as it could be,” said Rahul Matthan, partner at Trilegal and a Mint columnist.

In theory, de-identification could include anything from deleting or masking personal identifiers, like names, to generalizing or suppressing others, like an individual’s pin code.

Finding a way to protect privacy is critical for India, with the Supreme Court hearing petitions challenging the mandatory linking of Aadhaar to avail various social and welfare benefits.

One of the grounds for challenge is that the use of biometric information of an individual encroaches upon the individual’s privacy.

The Centre for Internet and Society, a Bengaluru-based research organisation, proposed that the UIDAI use tokens for KYC requirements. Under this method an individual can use a smart card and a personal identification number (PIN), rather than biometrics, at a UIDAI-controlled booth and generate a token number. That token number can be submitted to a telephone operator or a bank.

“UIDAI is currently considering this. They call it the dummy or virtual Aadhaar numbers. Under this a single agency cannot pull off the surveillance completely by themselves. So there is both a technical and institutional check,” said Sunil Abraham, executive director of the Centre for Internet and Society.

Another method could be shifting the emphasis to revoking consent rather than grant of consent to collect and store data.

This could be done using the same method that currently exists to filter unwanted calls and messages on phones via the do-not-disturb registry. But over and above these, creating the right regulatory framework is important.

“It has become absolutely necessary to have in place a law which governs the usage of misuse of data,” said former Supreme Court justice B.N. Srikrishna.

Srikrishna used to head a 10-member committee of experts constituted by the government to study various issues related to data protection, make specific suggestions on the principles to be considered and suggest a draft data protection bill.

The data protection law must balance the interests of all three stakeholders—the common citizens, data collectors and the state—and not focus on just one or two, Srikrishna said on Friday. There should also be methods in place to penalize or impose fines on companies or agencies in case of data breaches or misuses, he added. But imposing fines is not the ideal solution, according to experts.

“It’s really critical that we think about building in incentives to do better. If every violation results in a huge penalty, for instance, then the posture of companies will be a secretive, protective, legal defence posture rather than one that strives to constantly improve practices and technologies,” said Facebook Inc.’s global deputy chief privacy officer, Stephen Deadman.

Mark Zuckerberg’s India backlash imperils vision for free global web

When Facebook Inc.’s co-founder proposed bringing free Web services to India, his stated aim was to help connect millions of impoverished people to unlimited opportunity. Instead, critics have accused him of making a poorly disguised land grab in India’s burgeoning Internet sector. The growing backlash could threaten the very premise of Internet.org, his ambitious, two-year-old effort to connect the planet.

Indian authorities are circumspect because the Facebook initiative provides access to only a limited set of websites—undermining the equal access precepts of net neutrality. The telecommunications regulator is calling for initial comments by today on whether wireless carriers can charge differently for data usage across websites, applications and platforms. Losing this fight could imperil Facebook’s Free Basics, which allows customers to access the social network and select services such as Messenger and Microsoft’s Bing without a data plan.

“The India fight is helping shape debates elsewhere,” said Pranesh Prakash, policy director at the Centre for Internet and Society, a Bangalore-based non-profit advocacy group. “Activists in other countries such as Brazil, Venezuela and Colombia are watching this debate and will seize the momentum created in India.”

Zuckerberg’s argument for free Web access is based in part on Deloitte research showing that for every 10 people who are connected to the Web, one is lifted out of poverty and one job is created.

Facebook argues that by giving people free access to a small slice of the Internet, they will quickly see the value in paying for the whole thing. Zuckerberg has said his biggest challenge in connecting people to the Web isn’t access to cellular networks, but a social hurdle: he needs to prove to people who have never been online that the Internet is useful.

“Who could possibly be against this?” Zuckerberg wrote in an impassioned op-ed in the Times of India this week. “Surprisingly, over the last year there’s been a big debate about this in India.”

Zuckerberg’s plea underscores what’s at stake. Facebook already attracts 1.55 billion people monthly, or about half of the Internet-connected global population. To keep growing, the world’s largest social network needs to get more people online. Hence the billions of dollars Facebook is spending on projects to deliver the Web to under-served areas via drones, satellites and lasers. And Internet.org, which now spans 37 nations.

India, as the world’s second most populous nation, is arguably the most important piece of Zuckerberg’s Free Basics strategy. But the opposition is fierce. Critics note that the Facebook service doesn’t offer Web favourites such as Google Inc.’s search. Facebook has said it would be open to adding more features from competitors, but critics are skeptical of giving the social-networking giant such influence on the Internet.

Critics also say that by offering a limited swath of the Internet at comparatively slow speeds, the company is creating a poor-man’s or diluted version of the Web. That could stifle innovation by disadvantaging Indian startups building rival apps, or allow Facebook and its telecommunications carrier- partners to act as Internet gatekeepers.

One97 Communications Ltd, a mobile payment startup backed by Alibaba Group Holding Ltd, is one of several Indian tech companies that have come out against Facebook’s plans.

“We are totally against telcos preferring one developer over another,” One97 founder Vijay Shekhar Sharma said in a phone interview. “We are asking for access neutrality. We are hoping that all startups will be treated equally.”

Facebook is now scrambling to drum up support. It’s started a ‘Save Free Basics In India’ campaign, asking Indian users to support ‘digital equality’ by filling out a form that shoots an e-mail to regulators. That also has the effect of sending notifications to user’s friends unless they opt out.

Facebook has also taken out full-page advertisements, including one featuring a smiling Indian farmer and his family who the ads say used new techniques to double his crop yield. Bloomberg

Marco Civil da Internet: Brazil’s ‘Internet Constitution’

On March 25, 2014, Brazil's lower house of parliament passed bill no. 2126/2011, popularly known as Marco Civil da Internet. The Marco Civil is a charter of Internet user-rights and service provider responsibilities, committed to freedom of speech and expression, privacy, and accessibility and openness of the Internet. In this post, the author looks at the pros and cons of the bill.

Introduction:

Ten months ago, Edward Snowden’s revelations of the U.S. National Security Agency’s extensive, warrantless spying dawned on us. Citizens and presidents alike expressed their outrage at this sweeping violation of their privacy. While India’s position remained carefully neutral, or indeed, supportive of NSA’s surveillance, Germany, France and Brazil cut the U.S. no slack. Indeed, at the 68th session of the United Nations General Assembly, Brazilian President Dilma Rousseff (whose office the NSA had placed under surveillance) stated, “Tampering in such a manner in the affairs of other countries is a breach of International Law and is an affront to the principles that must guide the relations among them, especially among friendly nations.” Brazil, she said, would “redouble its efforts to adopt legislation, technologies and mechanisms to protect us from the illegal interception of communications and data.”

Some may say that Brazil has lived up to its word. Later this month, Brazil will be host to NETmundial, the Global Multi-stakeholder Meeting on the Future of Internet Governance, jointly organized by the Brazilian Internet Steering Committee (CGI.br) and the organization /1Net. The elephantine invisible presence of Snowden vests NETmundial with the hope and responsibility of laying the ground for a truly multi-stakeholder model for governing various aspects of the Internet; a model where governments are an integral part, but not the only decision-makers. The global Internet community, comprising users, corporations, governments, the technical community, and NGOs and think-tanks, is hoping devise a workable method to divest the U.S. Government of its de facto control over the Internet, which it wields through its contracts to manage the domain name system and the root zone.

But as Internet governance expert Dr. Jeremy Malcolm put it, these technical aspects do not make or break the Internet. The real questions in Internet governance underpin the rights of users, corporations and netizens worldwide. Sir Tim Berners-Lee, when he called for an Internet Bill of Rights, meant much the same. For Sir Tim, an open, neutral Internet is imperative if we are to keep our governments open, and foster “good democracy, healthcare, connected communities and diversity of culture”. Some countries agree. The Philippines envisaged a Magna Carta for Internet Freedom, though the Bill is pending in the Philippine parliament.

Marco Civil da Internet:

Last week, on March 25, 2014, the Brazilian Chamber of Deputies (the lower house of parliament) passed the Marco Civil da Internet, bill 2126/2011, a charter of Internet rights. The Marco Civil is considered by the global Internet community as a one-of-a-kind bill, with Sir Tim Berners-Lee hailing the “groundbreaking, inclusive and participatory process has resulted in a policy that balances the rights and responsibilities of the individuals, governments and corporations who use the Internet”.

The Marco Civil’s journey began with a two-stage public consultation process in October 2009, under the aegis of the Brazilian Ministry of Justice’s Department of Legislative Affairs, jointly with the Getulio Vargas Foundation’s Center for Technology and Society of the Law School of Rio de Janeiro (CTS-FGV). The collaborative process involved a 45-day consultation process in which over 800 comments were received, following which a second consultation in May 2010 received over 1200 comments from individuals, civil society organizations and corporations involved in the telecom and technology industries. Based on comments, the initial draft of the bill was revamped to include issues of popular, public importance, such as intermediary liability and online freedom of speech.

An official English translation of the Marco Civil is as yet unavailable. But an unofficial translation (please note that the file is uploaded on Google Drive), triangulated against online commentary on the bill, reveals that the following issues were of primary importance:

The fundamentals:

The fundamental principles of the Marco Civil reveal a commitment to openness, accessibility neutrality and democratic collaboration on the Internet. Art. 2 (see unofficial translation) sets out the fundamental principles that form the basis of the law. It pledges to adhere to freedom of speech and expression, along with an acknowledgement of the global scale of the network, its openness and collaborative nature, its plurality and diversity. It aims to foster free enterprise and competition on the Internet, while ensuring consumer protection and upholding human rights, personality development and citizenship exercise in the digital media in line with the network’s social purposes. Not only this, but Art. 4 of the bill pledges to promote universal access to the Internet, as well as “to information, knowledge and participation in cultural life and public affairs”. It aims to promote innovation and open technology standards, while ensuring interoperability.

The Marco Civil expands on its commitment to human rights and accessibility by laying down a “discipline of Internet use in Brazil”. Art. 3 of the bill guarantees freedom of expression, communication and expression of thoughts, under the terms of the Federal Constitution of Brazil, while at the same time guaranteeing privacy and protection of personal data, and preserving network neutrality. It also focuses on preserving network stability and security, by emphasizing accountability and adopting “technical measures consistent with international standards and by encouraging the implementation of best practices”.

These principles, however, are buttressed by rights assured to Internet users and responsibilities of and exceptions provided to service providers.

Rights and responsibilities of users and service providers:

Net neutrality:

Brazil becomes one of the few countries in the world (joining the likes of the Netherlands, Chile and Israel in part) to preserve network neutrality by legislation. Art. 9 of the Marco Civil requires all Internet providers to “to treat any data package with isonomy, regardless of content, origin and destination, service, terminal or application”. Not only this, but Internet providers are enjoined from blocking, monitoring or filtering content during any stage of transmission or routing of data. Deep packet inspection is also forbidden. Exceptions may be made to discriminate among network traffic only on the basis of essential technical requirements for services-provision, and for emergency services prioritization. Even this requires the Internet provider to inform users in advance of such traffic discrimination, and to act proportionately, transparently and with equal protection.

Data retention, privacy and data protection:

The Marco Civil includes provisions for the retention of personal data and communications by service providers, and access to the same by law enforcement authorities. However, record, retention and access to Internet connection records and applications access-logs, as well as any personal data and communication, are required to meet the standards for “the conservation of intimacy, private life, honor and image of the parties directly or indirectly involved” (Art. 10). Specifically, access to identifying information and contents of personal communication may be obtained only upon judicial authorization.

Moreover, where data is collected within Brazilian territory, processes of collection, storage, custody and treatment of the abovementioned data are required to comply with Brazilian laws, especially the right to privacy and confidentiality of personal data and private communications and records (Art. 11). Interestingly, this compliance requirement is applicable also to entities incorporated in foreign jurisdictions, which offer services to Brazilians, or where a subsidiary or associate entity of the corporation in question has establishments in Brazil. While this is undoubtedly a laudable protection for Brazilians or service providers located in Brazil, it is possible that conflicts may arise (with penal consequences) between standards and terms of data retention and access by authorities in other jurisdictions. In the predictable absence of harmonization of such laws, perhaps rules of conflicts of law may prove helpful.

While data retention remained a point of contention (Brazil initially sought to ensure a 5-year data retention period), under the Marco Civil, Internet providers are required to retain connection records for 1 year under rules of strict confidentiality; this responsibility cannot be delegated to third parties (Art. 13). Providers providing the Internet connection (such as Reliance or Airtel in India) are forbidden from retaining records of access to applications on the Internet (Art. 14). While law enforcement authorities may request a longer retention period, a court order (filed for by the authority within 60 days from the date of such request) is required to access the records themselves. In the event the authority fails to file for such court order within the stipulated period, or if court order is denied, the service provider must protect the confidentiality of the connection records.

Though initially excluded from the Marco Civil, the current draft passed by the Chamber of Deputies requires Internet application providers (such as Google or Facebook) to retain access-logs for their applications for 6 months (Art. 15). Logs for other applications may not be retained without previous consent of the owner, and in any case, the provider cannot retain personal data that is in excess of the purpose for which consent was given by the owner. As for connection records, law enforcement authorities may request a greater retention period, but require a court order to access the data itself.

These requirements must be understood in light of the rights that the Marco Civil guarantees to users. Art. 7, which enumerates these user-rights, does not however set forth their content; this is probably left to judicial interpretation of rights enshrined in the Federal Constitution. In any event, Art. 7 guarantees to all Internet users the “inviolability of intimacy and privacy”, including the confidentiality of all Internet communications, along with “compensation for material or moral damages resulting from violation”. In this regard, it assures that users are entitled to a guarantee that no personal data or communication shall be shared with third parties in the absence of express consent, and to “clear and complete information on the collection, use, storage, treatment and protection of their personal data”. Indeed, where contracts violate the requirements of inviolability and secrecy of private communications, or where a dispute resolution clause does not permit the user to approach Brazilian courts as an alternative, Art. 8 renders such contracts null and void.

Most importantly, Art. 7 states that users are entitled to clear and complete information about how connection records and access logs shall be stored and protected, and to publicity of terms/policies of use of service providers. Additionally, Art. 7 emphasizes quality of service and accessibility to the Internet, and forbids suspension of Internet connections except for failure of payments. Read comprehensively, therefore, Arts. 7-15 of the Marco Civil prima facie set down robust protections for private and personal data and communications.

An initial draft of the Marco Civil sought to mandate local storage of all Brazilians’ data within Brazilian territory. This came in response to Snowden’s revelations of NSA surveillance, and President Rousseff, in her statement to the United Nations, declared that Brazil sought to protect itself from “illegal interception of communications and data”. However, the implications of this local storage requirement was the creation of a geographically isolated Brazilian Internet, with repercussions for the Internet’s openness and interoperability that the Marco Civil itself sought to protect. Moreover, there are implications for efficiency and business; for instance, small businesses may be unable to source the money or capacity to comply with local storage requirements. Also, they lead to mandating storage on political grounds, and not on the basis of effective storage. Amid widespread protest from corporations and civil society, this requirement was then withdrawn which, some say, propelled the quick passage of the bill in the Chamber of Deputies.

Intermediary liability:

Laws of many countries make service providers liable for third party content that infringes copyright or that is otherwise against the law (such as pornography or other offensive content). For instance, Section 79 of the Indian Information Technology Act, 2000 (as amended in 2008) is such a provision where intermediaries (i.e., those who host user-generated content, but do not create the content themselves) may be held liable. However, stringent intermediary liability regimes create the possibility of private censorship, where intermediaries resort to blocking or filtering user-generated content that they fear may violate laws, sometimes even without intimating the creator of the infringing content. The Marco Civil addresses this possibility of censorship by creating a restricted intermediary liability provision. Please note, however, that the bill expressly excludes from its ambit copyright violations, which a copyright reforms bill seeks to address.

At first instance, the Marco Civil exempts service providers from civil liability for third party content (Art. 18). Moreover, intermediaries are liable for damages arising out of third party content only where such intermediaries do not comply with court orders (which may require removal of content, etc.) (Art. 19). This leaves questions of infringement and censorship to the judiciary, which the author believes is the right forum to adjudicate such issues. Moreover, wherever identifying information is available, Art. 20 mandates the intermediary to appraise the creator of infringing content of the reasons for removal of his/her content, with information that enables the creator to defend him- or herself in court. This measure of transparency is particularly laudable; for instance, in India, no such intimation is required by law, and you or I as journalists, bloggers or other creators of content may never know why our content is taken down, or be equipped to defend ourselves in court against the plaintiff or petitioner who sought removal of our content. Finally, a due diligence requirement is placed on the intermediary in circumstances where third party content discloses, “without consent of its participants, of photos, videos or other materials containing nudity or sexual acts of private character”. As per Art. 21, where the intermediary does not take down such content upon being intimated by the concerned participant, it may be held secondarily liable for infringement of privacy.

This restricted intermediary liability regime is further strengthened by a requirement of specific identification of infringing content, which both the court order issued under Art. 20 and the take-down request under Art. 21 must fulfill. This requirement is missing, for instance, under Section 79 of the Indian Information Technology Act, which creates a diligence and liability regime without requiring idenfiability of infringing content.

Conclusion:

Brazil’s ‘Internet Constitution’ has done much to add to the ongoing discussion on the rights and responsibilities of users and providers. By expressly adopting protections for net neutrality and online privacy and freedom of expression, the Marco Civil may be considered to set itself up as a model for Internet rights at the municipal level, barring a Utopian bill of rights. Indeed, in an effusive statement of support for the bill, Sir Tim Berners-Lee stated: “If Marco Civil is passed, without further delay or amendment, this would be the best possible birthday gift for Brazilian and global Web users.”

Of course, the Marco Civil is not without its failings. Authors say that the data retention requirements by connection and application providers, with leeway provided for law enforcement authorities to lengthen retention periods, is problematic. Moreover, the discussions surrounding data localization and a ‘walled-off’ Internet that protects against surveillance ignores the interoperability and openness that forms the core of the Internet.

On the whole, though, the Marco Civil may be considered a victory, on many counts. It is possibly the first successful example of a national legislation that is the outcome of a broad, consultative process with civil society and other affected entities. It expressly affirms Brazil’s commitment to the protection of privacy and freedom of expression, as well as to Internet accessibility and the openness of the network. It aims to eliminate the possibility of private censorship online, while upholding privacy rights of users. It seeks to reduce the potential for abuse of personal data and communication by government authorities, by requiring judicial authorization for the same. In a world where warrantless government spying extends across national border, such a provision is novel and desirable. One hopes that, when the global Internet community sits down at its various fora to identify and enumerate principles for Internet governance, it will look to the Marco Civil as an example of standards that governments may adhere to, and not necessarily resort to the lowest common denominator standards of international rights and protections.

Highlights for March 2019

The Indian Patent Office (IPO) on 1 March 2019, published a draft of the “Manual of Patent Office Practice and Procedure, Version 3.0”. CIS provided comments on patenting of computer related inventions.
The Centre for Internet and Society's Access to Knowledge (CIS-A2K) team has submitted its proposal for the year 2019-2020 to the Wikimedia Foundation. CIS-A2K has proposed to undertake content enrichment, skill development initiatives, cement partnership with existing partners and build relationships with new ones, and activities like Train-the-Trainer, Wikisource Conference, Wikimedia Summit India, Intensive Personal Wiki Training, supporting Indic Wikimedians through request page, etc.
Tarun Bharat Sangh (TBS), an organisation working on rejuvenation of rivers in India, has began documentation of rivers on Wiki, especially to draw attention to and mitigate the crisis of toxic deposits facing more than 40 rivers in India. The work was started by Jal Biradari, TBS’s Maharashtra based group, in Sangli district with the help of the Access to Knowledge (CIS-A2K) team of CIS. A report from the first pilot workshop conducted by CIS-A2K during 22-25 December 2018 at Tarun Bharat Sangh Ashram, in Alwar, Rajasthan has been published.
With the objective of connecting the open knowledge movement with design, the Access to Knowledge team at the Centre for Internet and Society co-organised the Wikigraphists Bootcamp India 2018 with the Wikimedia Foundation during September 28-30, 2018 in New Delhi. Saumyaa Naidu in a report has shared the learningsfrom the panel discussion aimed at exploring the potential collaborations between design and the open knowledge movement.
Karan Saini, Pranesh Prakash and Elonnai Hickok co-authored a policy brief titled Improving the Processes for Disclosing Security Vulnerabilities to Government Entities in India. The policy brief has recommended changes pertaining to current legislation, policy and practice to the Government of India regarding external vulnerability reporting and disclosure.
Arindrajit Basu, Elonnai Hickok and Aditya Singh Chawla co-authored a White Paper titled 'The Localisation Gambit'. The paper was edited by Pranav M.B., Vipul Kharbanda and Amber Sinha. Anjanaa Aravindan provided research assistance. Government of India has drafted multiple policy instruments which dictate that certain types of data must be stored in servers located physically within the territory of India. The White Paper serves as a resource for stakeholders attempting to intervene in this debate and arrive at a workable solution where the objectives of data localisation are met through measures that have the least negative impact on India’s economic, political, and legal interests.
The Technology Law Forum at the National Academy of Legal Studies and Research (NALSAR) has published the Report on Data Privacy and Citizen's Rights' Symposium.This report is a compilation of all the speakers' speeches during the panel discussion. Shweta Mohandas was one of the eight speakers at the panel and the excerpts from her presentation has also been covered in this report.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

Copyright and Patent

Access to Knowledge is a campaign to promote the fundamental principles of justice, freedom, and economic development. It deals with issues like copyrights, patents and trademarks, which are an important part of the digital landscape. We prepared the India report for the Consumers International IP Watchlist, made submission to the HRD Ministry on WIPO Broadcast Treaty, questioned the demonisation of pirates, and advocated against laws (such as PUPFIP Bill) that privatize public funded knowledge.

Highlights
CIS submitted comments on the draft Rights of Persons with Disabilities Rules for the consideration of the Department of Empowerment of Persons with Disabilities, Government of India. Anubha Sinha in a blog post has identified the various kinds of IP in an app and explained the protections available under Indian IPR law. CIS-A2K is conducting a Wiki internship project for students of New Law College, Pune under the guidance of Prof.Dr.Mukund Sarda, Dean and Principal of New Law College. In an Op-ed published in the Hindu, Sunil Abraham has stated that though biometrics may be appropriate for targeted surveillance by the state, it is wholly inappropriate for everyday transactions between state and law abiding citizens. CIS has published a survey that draws upon a range of literature including news articles, academic articles, and presentations and seeks to disaggregate the potential benefits and harms of big data, organising them into several broad categories that reflect the existing scholarly literature. CIS submitted comments on the Information Technology (Security of Prepaid Payment Instruments) Rules, 2017. The comments were in response to the Information Technology (Security of Prepaid Payment Instruments) Rules 2017. The Ministry of Electronics and Information Technology issued a consultation paper which called for developing a framework for security of digital wallets operating in the country. Ritam Sengupta, Dr. Richard Heeks, Sumandro Chattapadhyay, and Dr. Christopher Foster have co-authored a paper that presents exploratory research into “data-intensive development” that seeks to inductively identify issues and conceptual frameworks of relevance to big data in developing countries.

India has an estimated 70 million persons with disabilities who don't have access to read printed materials due to some form of physical, sensory, cognitive or other disability. As part of our endeavour to make available accessible content for persons with disabilities, we are developing a text-to-speech software in 15 languages with support from the Hans Foundation. Highlights

In a landmark judgement upholding the freedom of expression, the Supreme Court of India on March 24, 2015 struck down a provision (Section 66 A of the IT Act) which provided the power to arrest anyone for posting offensive comments online. Geetha Hariharan in her blog post captures the happenings which led to the court ruling.

CIS in partnership with Privacy International is doing the GSMA project that seeks to understand different legal and regulatory aspects of security and surveillance in India. The research outputs published thus far are now online in a consolidated blog post.
CIS as part of its RAW programme is inviting abstracts for essays that explore what it means to study Internet(s) in India today.
CIS is pleased to announce that the Researchers at Work (RAW) programme is supporting a new collaborative publishing project led by T.A.J. Residency / SKE Projects and or-bits.com. The first volume of the series titled 'Silicon Plateau' will feature contributions by a group of well-known artists, researchers, and writers.
Sumandro Chattapadhyay's paper titled 'Whose Open Data Community is it? Reflections on the Open Data Ecosystem in India' has been accepted for presentation at the Open Data Research Symposium to be held during the 3rd International Open Data Conference in Ottawa, Canada, on May 28-29 2015.
CIS has been invited to contribute two sections to the Asia Internet History - Third Decade (2001 - 2010) book edited by Dr. Kilnam Chon. The sections will discuss the activities and experiences of civil society organisations in Asia and India, respectively, in national, regional, and global Internet governance processes. Draft outlines of the sections are shared here . Comments and suggestions are invited.

CIS has prepared an open proposal to the Wikimedia Foundation to support its annual plan with USD 208,603.
CIS has prepared a draft work plan for the period July 2015 to June 2016 . This work plan consists of 18 programs across 6 verticals.
On December 24, 2015, Bharti Airtel, one of India's largest telecom players, announced the introduction of a new 'VOIP' usage policy for its mobile users. Tarun Krishnakumar analyses the developments in a blog post.

In his monthly column published in the Business Standard on March 4, 2015, Shyam Ponappa writes "systems and methods for access through elements that provide connectivity - spectrum, fibre-optic cable, coaxial cable, or "twisted-pairs" for ADSL - must be devised in an integrated manner and made available at low cost.
NVDA team as part of its project on developing text-to-speech software in 15 Indian languages has published key updates ofBengali and Assamese language testing.
In the year 2013 Nehaa Chaudhari had worked on a module on IP Rights for UNESCO's Open Access Curriculum. The module was published recently and is available under the CC-BY-SA 3.0 IGO license.

Rohini Lakshané in a blog post chronicles information about big-ticket lawsuits pertaining to mobile technology patents filed in India.

Accessibility and Inclusion

Under a grant from the Hans Foundation we are doing two projects. The first project is on creating a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India. CIS in partnership with CLPR (Centre for Law and Policy Research) compiled the National Compendium of Policies, Programmes and Schemes for Persons with Disabilities (29 states and 6 union territories). The publication has been finalised and is being printed. The draft chapters and the quarterly reports can be accessed on the project page. The second project is on developing text-to-speech software for 15 Indian languages. The progress made so far in the project can be accessed here.

Access to Knowledge

As part of the Access to Knowledge programme we are doing two projects. The first one (Pervasive Technologies) under a grant from the International Development Research Centre (IDRC) is for research on the complex interplay between pervasive technologies and intellectual property to support intellectual property norms that encourage the proliferation and development of such technologies as a social good. The second one (Wikipedia) under a grant from the Wikimedia Foundation is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the Pervasive Technologies project, Rohini Lakshané has written a blog entry that chronicles information on big-ticket lawsuits pertaining to mobile technology patents filed in India. As part of broader Access to Knowledge work UNESCO published a module on Intellectual Property Rights, Copyright and Alternative to a Strict Copyright Regime.

Nehaa worked on a module on Intellectual Property Rights for United Nations Educational, Scientific and Cultural Organization (UNESCO)'s Open Access Curriculum (Curriculum for Researchers) as part of a project for the Commonwealth Educational Media Centre for Asia. UNESCO published the module this year. Nehaa Chaudhari and Varun Baliga were among the Module preparation team. Nehaa Chaudhari was the writer for Units 1, 2 and 3: Understanding Intellectual Property Rights, Copyright and Alternative to a Strict Copyright Regime.

Open Proposal for Funding : CIS has prepared an open proposal for funding for about USD 208,603 from the Wikimedia Foundation. CIS is inviting comments on the proposal. CIS is proposing to contribute to the qualitative and quantitative growth of 12 Wikimedia projects across 9 Indian languages and associated communities, in addition to providing need based support to other Indic communities.
Access to Knowledge Work Plan : CIS has prepared the India Access to Knowledge work plan (July 2015 to June 2016). The work plan consists of 18 programs across 6 verticals. The first one (under a grant from Privacy International and International Development Research Centre (IDRC)) is on surveillance and freedom of expression (SAFEGUARDS). The Centre for Internet & Society (CIS) welcomes you to the third issue of its newsletter for the year 2013. In this issue we bring you an overview of our research programs, updates of events organised by us, events we participated in, news and media coverage, and videos of some of our recent events.

Jobs

Accessibility

CIS is doing two projects in partnership with the Hans Foundation. One of this is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and another is for developing a screen reader and text-to- speech synthesizer for Indian languages. CIS is also working with the World Blind Union and many other organisations to develop a Treaty for the Visually Impaired helped by the WIPO:

National Resource Kit for Persons with Disabilities
Anandhi Viswanathan from CIS and Manojna Yeluri from the Centre for Law and Policy Research are working in this project. Draft chapters have been published. Feedback and comments are invited from readers for the chapters on Lakshadweep, Meghalaya and Uttar Pradesh:

The Lakshadweep Chapter (by Anandhi Viswanathan, March 25, 2013): The union territory of Lakshadweep has not passed any legislation for persons with disabilities, but implements the provisions under the central laws. The benefits currently available to persons with disabilities in Lakshadweep include disability pension, unemployment allowance and grant for setting up kiosks.
The Meghalaya Chapter (by Manojna Yeluri, March 25, 2013): Meghalaya is one of the few north-eastern states, which has appointed a Commissioner for Disabilities. Most of the schemes and benefits given to persons with disabilities in Meghalaya are under centrally sponsored schemes. Very few schemes are initiated by the state government.
The Uttar Pradesh Chapter (by Manojna Yeluri, March 31, 2013): The Government of Uttar Pradesh has established shelter homes and vocational training centres in several parts of the states — most recently in Meerut, Bareilly and Gorakhpur. It has also undertaken to finance nearly 4340 corrective surgeries for polio across nine cities of Uttar Pradesh. It also intends to start several projects in 2013. These include the establishment of a Braille Press in order to produce Braille books, magazines and other study material.

Resources
We now have a new section on our website which contains all government notifications, RTI applications, and accessibility related resources: cases, statutes, etc. The following were published earlier this month:

Information about Schemes for Disabled Persons in Haryana We received this notification on schemes and policies for persons with disabilities from the Government of Haryana.
Haryana Government Notification (Hindi version): The notification that we received from the state government was in Hindi. We will put up the English translation soon.
West Bengal (Govt) Notifications: We received a series of notifications from the West Bengal Government from its various departments such as finance, higher education, transport, health and family welfare, labour, land and land reforms, panchayats and rural development, etc. OCR versions of the same have been published.
Lakshadweep (Govt) Notifications: Notifications received from the Lakshadweep Government including guidelines for functioning of KIOSKS, grant of unemployment allowance and special jobs to persons with disabilities, issuing identity card to persons with disabilities for availing government benefits, etc., are published. OCR versions have also been put up.

Access to Knowledge and Openness

The Wikimedia Foundation awarded CIS a two year grant of INR 26,000,000 to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. CIS also promotes openness including open government data, open standards, open access, and free/libre/open source software through its Openness programme.

Wikipedia

Beginning from September 1, 2012, Wikimedia Foundation awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of four members based in Delhi: T. Vishnu Vardhan, Nitika Tandon, Subhashish Panigrahi and Noopur Raval, and one team member Dr. U.B. Pavanaja who is working from Bangalore office.

Indic Wikipedia Visualisation Project

Visualising Basic Parameters (by Sajjad Anwar and Sumandro Chattapadhyay, March 26, 2013): Sajjad and Sumandro bring you a visualisation of the growth of Indic Wikipedia in this first post on Indic Wikipedia Visualisation project. They look into the different aspects of the past and present activities of Indic Wikipedias, and divide the visualisation into three different focus areas: (1) basic parameters, (2) geographic patterns of edits, and (3) exploring the topics that receives the greatest number of edits.

Iraqi Public Data Scenario Workshop: A Summary (by Sumandro Chattapadhyay, March 26, 2013): A workshop on public data was conducted by Sunil Abraham and Sumandro Chattapadhyay for the officials of the Government of Iraq. It was organized by UNDP Iraq in Amman, Jordan from October 18 to 23, 2012. Sumandro Chattapadhyay shares with us the developments from the workshop held over five days.

Upcoming Events

Pig Workshop (organized by HasGeek, Alchemy Solutions, Domlur, Bangalore, 9.00 a.m. to 6.00 p.m.): A workshop on how to use Pig for mining useful information from data. It is open to programmers who have a background in Java programming, some familiarity with Hadoop and MapReduce algorithms, and have worked with large chunks of data.

Internet Governance

The Internet Governance programme conducts research around the various social, technical, and political underpinnings of global and national Internet governance, and includes online privacy, freedom of speech, and Internet governance mechanisms and processes. Currently, CIS is doing a project with Privacy International, London to facilitate research and events around surveillance, and freedom of speech and expression.

Draft Human DNA Profiling Bill (April 2012): High Level Concerns (by Elonnai Hickok, March 12, 2013). The post examines the high level concerns that CIS has with the April 2012 draft of the Bill.
Human DNA Profiling Bill 2012 Analysis (by Jeremy Gruber, Council for Responsible Genetics, US, March 19, 2013). Jeremy provides an analysis of the Human DNA Profiling Bill, 2012. He says that India’s updated 2012 Human DNA Profiling Bill offers largely superficial changes from its predecessor, the Draft DNA Profiling Bill, 2007.

The Privacy (Protection) Bill 2013: A Citizen's Draft (by Bhairav Acharya, March 26, 2013). Bhairav Acharya has drafted the Privacy (Protection) Bill 2013. It contains provisions that speak to data protection, interception, and surveillance and also establishes the powers and functions of the Privacy Commissioner, and lays out offenses and penalties for contravention of the Bill. The Bill represents a citizen's version of possible privacy legislation for India, and will be shared with key stakeholders including civil society, industry, and government.

CIS welcomes the report by the Standing Committee on Subordinate Legislation, in which it has lambasted the government and has recommended that the government amend the Rules it passed in April 2011 under section 79 of the Information Technology Act. Knowledge Repository on Internet Access

CIS in partnership with the Ford Foundation is executing a project on Internet Access. It covers the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access and will touch upon various polices and regulations which has an impact on internet access and bodies and mechanism which are responsible for formulation policies related to internet access. Research

New series from RAW, new Clusters now Online!

From 2012 to 2015, the RAW series will build research clusters in the field of Digital Humanities. The Digital will be used as a way of unpacking the debates in humanities and social sciences and look at the new frameworks, concepts and ideas that emerge in our engagement with the digital. We hope to build knowledge networks and production of new knowledge around questions of body, governance and cultural production in the digital times that we live in. Spearheaded by experts in the field of science, technology, society and culture the clusters aim to produce and document new conversations and debates that shape the contours of Digital Humanities in Asia.

Locating the Mobile: An Ethnographic Investigation into Locative Media in Melbourne, Bangalore and Shanghai

As yet we know little about the impact locative media is having, and will have upon people’s livelihoods and identity, or on public policy around privacy, identity, security and cultural production. Discourse in the field has opened up questions of art, innovation and experimentation. But there is a dearth of nuanced research on locative media that provides in-depth, contextual accounts of its socio-cultural and political dimensions. Not much work has been conducted into locative media as it migrates from art to the ‘messy’ area of everyday. The project seeks to address this knowledge gap by studying locative media in Bangalore, Melbourne and Shanghai.

Users of technologies often express their engagement with technologies in affective terms. The interfaces that we see all around us constantly deflect our attention, emotions and desires on to different surfaces, creating flattened universes with the promises of deep immersion. Digging deep into interfaces, to examine peoples’ relationships with the digital interfaces around them the research cluster examines: What are the affective relationships that people have with their interfaces? What goes into anthropomorphising an interface? What are the larger politics of labour, performance and ownership that surround interface design? What are the ways in which people simulate presence and connections through their interfaces? How is the human presumed in computer-human interface design? What aesthetic and political moves are we witnessing with the rise of interface mediated publics? What and who is made opaque when interfaces become transparent? When interfaces get distributed, what are the possibilities and potential for art, theory and practice to move into new forms of politics?

Habits of Living: Global Networks, Local Affects
Wendy Chun (Professor, Brown University), Kelly Dobson, (Chair, Digital + Media, RISD, Providence), Matthew Fuller, David Gee (Reader in Digital Media, Center for Cultural Studies, Goldsmiths College, University of London) and Eivind Rossaak, (Associate Professor, Department of Research, National Library of Norway, Oslo).
This is a global collaborative project to renew the conceptual power of networks. It concentrates on changing the habits of living. The Department of Modern Culture and Media at Brown University will be an important locus. Habits are crucial to understanding networks not simply as broad organizational structures but also as structures created through constant actions that are both voluntary and involuntary.

Who’s the Everyday Digital Native? A global video contest finds the answer!
CIS and Hivos are excited to announce the top five videos. The finalists will each win EUR 500. According to Nishant Shah, the 12 video proposals show that the everyday digital native does not wake up in the morning and think, ‘today I will change the world’. Yet, in their everyday lives, when they see the possibility of producing a change in their immediate environments, they turn to the digital to find networks that can start a change.

The Tutorial was preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility on March 13, 2012. Expert Meeting on Freedom of Expression and Intellectual Property Rights (London, November 18, 2011): The meeting was organized by ARTICLE 19. Nineteen international scholars, experts and human rights activists met to explore the antagonistic relationship between Intellectual Property (IP) and the rights to freedom of expression and information. Pranesh Prakash was one of the participants.

Free Arduino Workshop (For Beginners): (CIS, Bangalore, March 3, 2012). The workshop drew participants such as interaction designers, artists and those enthusiastic to get started with creative projects but didn’t have prior experience with electronics. About 20 people participated in the workshop.

India Explores the Balance Points between Freedom of Expression, Privacy, National Security and Law Enforcement (New Delhi, March 5, 2012). Sunil Abraham participated in this closed-door meeting jointly organised with the Global Network Initiative. Issues relating to freedom of expression and privacy were discussed in the meeting.
Climate Change and Controversy Mapping (Indian Institute of Science, Bangalore, March 19 to 21, 2012). The Devechia Centre for Climate Change, the Indian Institute of Science and CIS organized a three-day workshop with Professor Bruno Latour. Doctorate students doing empirical work in various types of ecological crisis participated in the event and experimented with some of the digital tools and methods developed within the "mapping controversies" consortium.
GeekUp with Erica Hagen (CIS, Bangalore, March 1, 2012). HasGeek organized a GeekUp with Erica Hagen of the GroundTruth Initiative. Erica gave a lecture on the theme: "From Information to Empowerment: Unpacking the Equation.
Cartonama Workshop (CIS, Bangalore, March 2 and 3, 2012). HasGeek organized a hands-on training for managing and building location based services. Twenty-two participants attended the workshop.

The Abrams Institute for Freedom of Expression at Yale Law School is holding a conference on global censorship from March 30 to April 1, 2012, at Yale Law School. The programme is sponsored by the Information Society Project at Yale Law School and Thomson Reuters. Researchers@Work

RAW is a multidisciplinary research initiative. CIS believes that in order to understand the contemporary concerns in the field of Internet and society, it is necessary to produce local and contextual accounts of the interaction between the Internet and socio-cultural and geo-political structures. To build original research knowledge base, the RAW programme has been collaborating with different organisations and individuals to focus on its three year thematic of Histories of the Internets in India. Monographs finalised from these projects are online for peer review.

The India Game Developer Conference held at Nimhans Convention Centre on the 27th of February, 2010 was attended by Arun Menon who is working on The Gaming and Gold Project at The Centre for Internet and Society. The Developer forum brought together game developers from different sectors of the Game Production Cycle, with hardware manufacturers like Nvidia demonstrating their latest 3d technology and Software developers like Crytek and Adobe demonstrating the latest in developer tools for creating and editing games on multiple platforms.

10 Legendary Obscene Beasts
Nishant Shah analyses a peculiar event of vandalism which has now become the core of free speech and anti-censorship debates in mainland China. Looking at the structure of user generated knowledge websites and the specific event on the Chinese language encyclopaedia, 'Baidu Baike', he shows how, in cities where spaces of political spectacle and public protest are quickly diminishing, the Internet has become a tool for producing new public spaces of demonstration and protest.

Aman Nair, Arinjay Vyas, Pallavi Bedi, and Garima Saxena authored a response to the Supreme Court E-committee’s draft vision document of phase III of the E-courts project. This response recommends consideration be given to the digital and gender divide, and lack of clarity in the document on several data-related aspects. [link]

Privacy

The proposed Personal Data Protection Bill, 2019 is being deliberated by the Joint Parliamentary Committee and is expected to be tabled in the Monsoon Session of Parliament. Pallavi Bedi and Amber Sinha co-authored a white paper to examine the personal data implications on welfare delivery models in India and to suggest ways to operationalise key provisions. [link]
Shweta Mohandas authored an article for Rajiv Gandhi National University of Law Student Research Review (RSRR). In this article, which forms a part of RSRR’s ‘Excerpts from Experts Blog Series,’ Shweta examines whether Indian data protection legislation can act as a check on growing workplace surveillance. Aman Nair and Arindrajit Basu examine the changes in the context of data sharing between WhatsApp and Facebook as being an anticompetitive action in violation of the Indian Competition Act, 2002. Having previously examined the implications of WhatsApp’s changes to its privacy policy in 2021, this issue brief is the second output of the series examining the effects of the changes. [link]
In a blog-post, Pallavi Bedi provides recommendations for the Covid vaccine intelligence network (Co-Win) platform. She says that as a first step it is essential that Co-Win has a separate dedicated privacy policy which conforms to the internationally accepted privacy principles and enumerated in the Personal Data Protection Bill. Freedom of Expression, and Intermediary Liability

In February, the Advertising Standards Council of India (ASCI) had issued draft rules for regulation of digital influencers, with an aim to “understand the peculiarities of [online] advertisements and the way consumers view them,” as well as to ensure that: “consumers must be able to distinguish when something is being promoted with an intention to influence their opinion or behaviour for an immediate or eventual commercial gain.” Torsha Sarkar and Shweta Mohandas respond with comments and recommendations to the rules. In a research paper, Noopur Raval offers critical historical insights from the fields of international development, anthropology, and postcolonial history to caution against both the possible harms of gender disaggregated datafication, as well as the consequences of non-participatory datafication of women. Sameet Panda and Vipul Kumar wrote a blog for Privacy International pointing the failures in the digitisation of India’s food security programme in light of the exclusion of married women of Odisha. [link]
Shreya Ghosh, a research scholar at the Centre for Political Studies, Jawaharlal Nehru University, New Delhi authored an article in EPW on access to welfare and health for women during the initial phase of the pandemic. [link]
