Feminist Methodology in Technology Research: A Literature Review

Abstract

Feminist research methodology is a vast body of knowledge, spanning across multiple disciplines including sociology, media studies, and critical legal studies. This literature review aims to understand key aspects of feminist methodology across these disciplines, with a particular focus on research on technology and its interaction with society. Stemming from the argument that the ontological notion of objectivity effaces power relations in the process of knowledge production, feminist research is critical of the subjects, producers, and nature of knowledge. Section I of the literature review explores this argument along with a range of theoretical concepts, such as standpoint theory and historical materialism, as well as principles of feminist research derived from these, such as intersectionality and reflexivity.

Given its critique of the "god's eye view" (Madhok and Evans, 2014) of objectivist research, feminist scholars have largely developed qualitative methods that are more conducive to acknowledgement of power hierarchies. Additionally, some scholars have recognised the political value in quantification of inequalities such as the wage gap, and have developed intersectional quantitative methods that aim at narrowing down measurable inequalities. Both sets of methods are explored in Section II of the literature review, interspersed with examples from research focused on technology.

Introduction

According to authoritative accounts on the subject, while research focused on gender or women predates its arrival, the field of ‘feminist methodology’ explores questions of epistemology and ontology of research and knowledge. Initiated in scholarship arising out of the second wave of North American feminism, it theoretically anchors itself in the post-modernist and post-structuralist traditions. It additionally critiques positivism for being a project furthering patriarchal oppression. North American feminist scholars critique traditional methods within the social sciences from an epistemological perspective, for producing acontextual and ahistorical knowledge, replicating the tendency of positivist science to enumerate and measure subjective social phenomena. This, according to them, leads to the invisiblising of the web of power relations within which the ‘known’ and ‘knower’ in knowledge production are placed. This is then used to devise methods and underlying principles and ethics for conducting more egalitarian research, aimed at achieving goals of social justice.

The second wave feminist movement was itself critiqued by Black and other feminists from the global South for being exclusionary of non-white and heterosexual identities. Given its origins in the global North, scholars from the South have interrogated the meaning of feminism and feminist research in their context. Some African scholars even detail difficulty in disclosing a project as feminist publicly due to popular resistance to the term feminism, which stems from it being rejected by certain social groups as an alien social movement that’s antithetical to their “African cultural values." Their own critique of “White feminism” comes from its essentialization of womanhood and the resultant negation of the (neo)colonial and racialised histories of African women. This has led scholars from the global South to critically interrogate feminism and feminist methods. They acknowledge the multiplicity of feminisms, and initiate creative inquiries into different forms of feminist methodology. Feminist researchers that work in contexts of political violence, instability, repression, scarcity of resources, poor infrastructure, and/or lack of social security, have pointed out that traditional research methods assume conditions that are largely absent in their realities, leading them to experiment with feminist research.

Feminist research across these variety of contexts raises ontological and epistemological concerns about traditional research methods and underlying assumptions about what can be known, who can know, and the nature of knowledge itself. It argues that knowledge production has historically led to the creation of epistemic hierarchies, wherein certain actors are designated as ‘knowers’ and others as the ‘known’. Such hierarchies wreak epistemic violence upon marginalised subjects by denying them the agency to produce knowledge, and delegitimize forms of knowledge that aren’t normative. Acknowledging the role of power in knowledge production has the radical implication that the subjectivities of the researchers and the researched inherently find their way into research and more broadly, knowledge production. This challenges the objectivity and “god’s eye view” of traditional humanistic knowledge and its processes of production. Feminist research eschews scientifically orthodox notions of how “valid knowledge will look”, and creates novel resources for understanding epistemic marginalization of various kinds. It then provides a myriad of tools to disrupt structural hierarchies through and within knowledge production and dissemination.

Feminist research, given its evolution from living movements and theoretical debates, remains a contested domain. It has reformulated a range of qualitative and quantitative research methods, and also surfaced its own, such as experimental and action-based. What these have in common are theoretical dispositions to identify, critique, and ultimately dismantle power relations within and through research projects. It is thus “critical, political, and praxis oriented. Several disciplines with the social sciences, such as feminist technology studies, cyberfeminism, and cultural anthropology, have built feminist approaches to the study of technology and technologically mediated social relations. However, this continues to remain a minor strand of research on technology.

This literature review aims to address that gap through scoping of such methods and their application in technological research. Feminist methodology provides a critical lens that allows us to explore questions and areas in technology-based research that are inaccessible by traditional methods. This paper draws on examples from technology-focused research, covering key interdisciplinary feminist methods across fields such as gender studies, sociology, development, and ICT for development. In doing so, it actively constructs a history of feminist methodology through authoritative sources of knowledge.

Feminist Internet Research Network (FIRN) Convening Design

Ambika Tandon attended a workshop organized by Association for Progressive Communications for grantees of the Feminist Internet Research Network as a panelist on a session on feminist research methods.. The workshop was held from 27 February to 1 March, in Malaysia. Represented from 8 organizations attended the workshop.

Objectives of the convenining

To inaugurate a network of feminist researcher in the field of digital technology for ongoing collaboration, advice and active solidarity.
To start trust building within the network through shared values and plot how it will work and how it will expand.
To facilitate exchange of learnings and capacity building among the network members and other resource persons, in particular.
To facilitate peer-feedback, collaboration and interdisciplinary discussions on research design, methodologies and research plans of the selected projects and other resource persons.
To get feedback on overall FIRN project research methodology/design.
To explore new and innovative methods, as well as get understand key developments and challenges in more established ways of collecting and analysing data in the four areas of the research initiative.

Feminist Information Infrastructure Workshop with Blank Noise and Sangama

Akriti Bopanna, Swaraj Paul Barooah and Ambika Tandon as part of the project on Feminist Information Infrastructure, conducted a full-day workshop with Sangama and Blank Noise on August 8, 2018 at CIS, Bangalore.

The workshop focused around fleshing out the research projects that interns at Blank Noise and Sangama will be undertaking, and going over ethical guidelines for feminist research for interviews.

There will be three projects across the two organizations, looking at

The identification process and challenges therein for the trans community,
The impact of mobile phone usage on sex work, and
Impact of social media on the lives of sexual minorities (specifically gay men), focusing on pleasure, social interaction, safety, and peerveillance.

Submission by the Centre for Internet and Society on Draft New ICANN By-laws

The Centre for Internet & Society sent its comments on the Draft New ICANN Bylaws. The submission was prepared by Pranesh Prakash, Vidushi Marda, Udbhav Tiwari and Swati Muthukumar. Special thanks to Sunil Abraham for his input and feedback.

We at the Centre for Internet and Society are grateful for the opportunity to comment on the draft new ICANN by-laws. Before we comment on specific aspects of the Draft by-laws, we would like to make a few general observations:

Broadly, there are significant differences between the final form of the by-laws and that which has been recommended by the participants in the IANA transition process through the ICG and the CCWG. They have been shown to be unnecessarily complicated, lopsided, and skewed towards U.S.-based businesses in their past form, which continues to reflect in the current form of the draft by-laws.

The draft by-laws are overwrought, but some of that is not the fault of the by-laws, but of the CCWG process itself. Instead of producing a broad constitutional document for ICANN, the by-laws read like the worst of governmental regulations that go into unnecessary minutiae and create more problems than they solve. Things that ought not to be part of fundamental by-laws — such as the incorporating jurisdiction of PTI, on which no substantive agreement emerged in the ICG — have been included as such.

Simplicity has been seen as a sin and has made participation in this complicated endeavour an even more difficult proposition for those who don’t choose to participate in the dozens of calls held every month. On specific substantive issues, we have the following comments:

Jurisdiction of ICANN’s Principal Office

Maintaining by-law Article XVIII, which states that ICANN has its principal office in Los Angeles, California, USA, these Draft by-laws make an assumption that ICANN’s jurisdiction will not change post transition, even though the jurisdiction of ICANN and its subsidiary bodies is one of the key aspects of post transition discussion to be carried out in Work Stream 2 (WS2). Despite repeated calls to establish ICANN as an international community based organisation (such as the International Red Cross or International Monetary Fund), the question of ICANN's future jurisdiction was deferred to WS2 of the CCWG-Accountability process. All of the new proposed by-laws have been drafted with certainty upon ICANN's jurisdiction remaining in California. Examples of this include the various references to the California Civil Code in the by-laws and repeated references to entities and structures (such as public benefit corporations) in the fundamental by-laws of the ICANN that can only be found in California.

This would make redundant any discussion in WS2 regarding jurisdiction, since they cannot be implemented without upending the decisions relating to accountability structures made in WS1, and embedded in the by-laws.

CIS suggests an provision expressly be inserted in the by-laws to allow changes to the by-laws in WS2 insofar as matters relating to jurisdiction and other WS2 issues are concerned, to make it clear that there is a shared understanding that WS2 decisions on jurisdiction are not meant to be redundant.

Jurisdiction of the Post-Transition IANA Authority (PTI)

The structure of the by-laws and the nature of the PTI in Article 16 make its Californian jurisdiction integral to the very organisation as a whole and control all its operations, rights and obligations. This is so despite this issue not having been included in the CWG report (except for footnote 59 in the CWG report, and as a requirement proposed by ICANN’s lawyers, to be negotiated with PTI’s lawyers, in Annex S of the CWG report). The U.S. government’s requirement that the IANA Functions Operator be a U.S.-based body is a requirement that has historically been a cause for concern amongst civil society and governments. Keeping this requirement in the form of a fundamental by-law is antithetical to the very idea of internationalizing ICANN, and is not something that can be addressed in Work Stream 2.

CIS expressed its disagreement with the inclusion of the U.S-jurisdiction requirement in Annex S in its comments to the ICG. Nothing in the main text of the CWG or ICG recommendations actually necessitate Californian jurisdiction for the PTI. Thus, clearly the draft by-laws include this as a fundamental by-law despite it not having achieved any form of documented consensus in any prior process. This being a fundamental by-law would make shifting the PTI’s registered and principal office almost impossible once the by-laws are passed.

No reasoning or discussion has been provided to justify the structure, location and legal nature of the PTI. The fact that the revenue structure, by-laws and other details have not even been hinted at in the current document, indicate that the true rights and obligations of PTI have been left at the sole discretion of the ICANN while simultaneously granting it fundamental by-law protection. This is not only deeply problematic on front of delegation of excessive responsibility for a key ICANN function without due oversight but also leads to situation where the community is agreeing to be bound to a body whose fundamental details have not even been created yet, and yet is a fundamental by-law.

CIS would therefore suggest that the PTI related clauses in the by-laws be solely those on which existing global Internet community consensus can be shown, and the PTI’s jurisdiction is not something on which such consensus can be shown to exist. Therefore the by-laws should be rewritten to make them agnostic to PTI’s jurisdiction. Further, CIS suggests that the law firm appointed for PTI be non-American, since U.S.-based law firms capable law firms in Brazil, France, and India.

We would also like to note that we have previously proposed that PTI’s registered office and ICANN’s registered office be in different jurisdictions to increase jurisdictional resilience against governmental and court-based actions.

Grandfathering Agreements Clause

A fair amount of discussion has taken place both in the CCWG mailing list about Section 1.1 (d)(ii), which concerns the inclusion of certain agreements into the scope of protection granted to ICANN from its Mission and Objective statement goals. CIS largely agrees with the positions taken by the IAB and CCWG in their comments of demanding the removal of parts B, C, D E and F of Section 1.1(d)(ii) as all of these are agreements that were not included in the scope of the CCWG Proposal and a fair few of these agreements (such as the PTI agreement) have not even been created yet. This leads to practical and legal issues for the ICANN as well as the community as it restricts possible accountability and transparency measures that may be taken in the future.
CIS as its suggestion therefore agrees with the IAB and CCWG in this regard and supports the request by them that demand by these grandfathering provisions be removed.

Inspection Rights

Section 22.7 severely limits the transparency of ICANN’s functioning, and we believe it should be amended.

(a) It limits Inspection Requests to Decisional Participants and does not allow for any other interested party to make a request for inspection. While the argument has been made that Californian law requires inspection rights for decisional participants, neither the law nor CCWG’s recommendations require restricting the inspection rights to decisional participants. CIS’s suggestion is to allow for any person in the public to make a request for examination, but to have to declare the nature of the public interest behind requests for non-decisional participants, so that an undue number of requests are not made for the purpose of impairing the operations of the organisation.

(b) The unclear but extremely limited definition of ‘permitted scope’, which does not allow one to question any ‘small or isolated aspect’ of ICANN’s functioning, where there is no explicit definition of what constitutes the scope of matters relevant to operation of ICANN as a whole, leaving a loophole for potential exploitation. CIS suggests the removal of this statement and to allow only for limitations listed in Section 22.7 (b) for Inspection Requests.

(3) There is no hard deadline provided for the information to be made available to the querying body, thus allowing for inordinate delays on the part of the ICANN, which is open to abuse. CIS suggests the removal of the clause ‘or as soon as reasonably practicable thereafter’ in this section.

(4) The need for insisting that the material be used only for restricted purposes. CIS suggests that as a step towards ICANN’s transparency, it is essential that they allow the use of the information for any reason deemed necessary by the person demanding inspection. There is no clear reason to require restriction to EC proceedings for non-confidential material. This requirement should be removed.

Work Stream 2 Topics

Section 27.2, which covers necessary topics for WS2, currently does not include key aspects such as PTI documents, jurisdictional issues, etc. In this light, we suggest that they be included and a clause be inserted to indicate that this list of topics is indicative and the CCWG can expand the scope of items to be worked on in WS2 as well as make changes to work completed in WS1 (such as these by-laws) to meet WS2 needs as well.

FOI-HR

Section 27.3 (a) requires the FOI-HR to be approved by "(ii) each of the CCWG-Accountability’s chartering organizations..” which is inconsistent with the CCWG proposal that forms the basis for these by-laws. The requirement of formal approval from every Chartering Organisation in the current draft is inconsistent with Annex 6 of the CCWG proposal, that has no such requirement.

CIS strongly advocates for a change in the bylaw text to align with the intent of the CCWG Accountability report, and to reflect that the process of developing the FOI-HR shall follow the same procedure as Work Stream 1.

Contracts with ICANN

Section 27.5 currently states that “Notwithstanding the adoption or effectiveness of the New by-laws, all agreements, including employment and consulting agreements, entered by ICANN shall continue in effect according to their terms.”

As the section currently stands, there is a possibility that prior to the creation of by-laws, agreements that may be in contravention of the by-laws may be brought forth intentionally before the commencement of the operation of ICANN’s Mission statement in the said by-laws. The clause may be updated as follows to avoid this —

“Notwithstanding the adoption or effectiveness of the New by-laws, all agreements, including employment and consulting agreements, entered by ICANN shall continue in effect according to their terms, provided that they are in accordance with ICANN’s Mission Statement.”

Feedback to the NIA Bill

Malavika Jayaram and Elonnai Hickok introduce the formal submission of CIS to the proposed National Identification Authority of India (NIA) Bill, 2010, which would give every resident a unique identity. The submissions contain the detailed comments on the draft bill and the high level summary of concerns with the NIA Bill submitted to the UIDAI on 13 July, 2010.

The UID draft bill is a proposed legislation that authorizes the creation of a centralized database of unique identification numbers that will be issued to every resident of India. The purpose of such a database is characterized as ensuring that every resident is provided services and benefits. The UID project was first set up and introduced to the public in February 2009 by the planning committee. In June 2010, a draft bill was proposed which attracted public debates and opinions for over two weeks. Currently the bill is being considered by Parliament in the winter session (July-August 2010). If the Parliament of India approves the bill, it may be enacted during Winter 2010.

CIS has closely followed the UID project and reviewed the bill right from the time when it was first issued. and has worked to initiate and contribute to a public debate including attending of workshops in Delhi on 6 May, 2010 and in Bangalore on 16 May, 2010.

We respect the fact that civil society has many voices. That said, in our criticisms, suggestions, and analysis of the UID draft bill, we are asking for a simple, well-defined document, the language and structure of which expressly precludes abuse of a centralized identification database. The document should provide solely for its stated purpose of enabling the provision of benefits to the poor. Along with this mandate we believe the document should give clear rights of choice, control, and privacy to the Aadhaar number holder. Below is a summary of our general comments with citations to specific sections of the draft bill. A detailed section by section critique is attached along with our high level summary of concerns. The compilation and synthesis of detailed critiques was done by Malavika Jayaram.

Summary of High Concerns

Clarity of Definition and Purpose

Most importantly we find that in order to adhere to the stated purpose of the bill there is a need to limit and better define language in the relevant sections of the bill. This includes the powers and purpose of the Authority and the overarching scheme of the bill. We are concerned that the over-breadth and generality of the language will open up the opportunity for more information to be collected than originally stated. Further, definition will act to prevent uncontrolled or unwanted change in the project’s scope, and will clearly limit the usage of the Aadhaar numbers to the facilitation of the delivery of social welfare programs.

For the bill to be in line with its original purpose of reaching out to the poor, we also believe the issue of fees must be addressed. We find that there is an inadequate definition in the bill of what fees shall be applied for authentication of Aadhaar numbers. Also we find that it is incompatible with the bill’s stated purpose to require an individual to pay to be authenticated. The bill should provide that no charges will be levied for authentication by registrars and other service providers for certain categories of Aadhaar number holders (BPL, disabled, etc.), and that charges will be limited/capped in other cases. This will bring the bill in line with the statement in Chapter II 3 (1) “Every resident shall be entitled to obtain an Aadhaar number on providing his demographic information and biometric information to the Authority in such a manner as may be specified by regulations” and Chapter 3 (10 ) “The Authority shall take special measures to issue Aadhaar numbers to women, children, senior citizens, persons with disability, migrant unskilled and unorganized workers, nomadic tribes or such other persons who do not have any permanent dwelling house and such other categories of individuals as may be specified by regulations. If a fee must be permitted, a cap/safeguard should be put in place to ensure that the fee does not become a mechanism of abuse.

Protection of the Citizen

The bill should ensure the protection of citizens’ rights to privacy and freedom of choice. To do this it is important that the bill is voluntary, allows for the protection of anonymity, and is clear on how data will be collected, stored and deleted. Measures should be taken towards ensuring that the Aadhaar number is truly voluntary. Accordingly, a prohibition against the denial of goods, services, entitlements and benefits (private or public) for lack of a UID number – provided that an individual furnishes equivalent ID is necessary. The bill should also spell out the situations in which anonymity will be preserved and/or an Aadhaar number should not be requested such as a person’s sexuality/sexual orientation and marital status/history. Furthermore, the bill should require the Authority, registrars, enrolling agencies and service providers to delete/anonymize/obfuscate transaction data according to defined principles after appropriate periods of time in order to protect the privacy of citizens.

Motivations of the UID Bill

Since the submission of the high level summary, we note that a list of 221 agencies empanelled by the UIDAI has been uploaded onto the website (by a memo dated 15 July, 2010). A swift reading reveals that most of the agencies who are going to help enroll people into the UIDAI system are not NGOs, CSOs or other welfare oriented not-for-profit entities; rather, they are largely IT companies and commercial enterprises. This begs the question as to whether the UID scheme/Aadhaar is truly geared towards delivery of benefits and inclusivity of the poor and marginalized. Already concerns have been voiced that the “ecosystem” of registrars and enrolling agencies contemplated by the scheme, to the extent that it envisages a public-private partnership, could firstly, be “hijacked” or “captured” by commercial motives and result in sharing of data, security breaches, compromised identities, loss of privacy, data mining and customer profiling, and secondly, end up neglecting the very sections of society that the scheme allegedly most wants to help. The list of empanelled companies makes this even more likely and imminent a concern. Without casting aspersions on any of those entities, we would like to highlight that this sort of delegated structure raises several concerns.

Additionally, we find the speed and efficiency with which the UIDAI juggernaut is signing MoUs with states, banks and government agencies on the one hand, and issuing tenders, RFPs, RFQs and otherwise seeking proposals and awarding contracts to private entities – in the absence of any Parliament-sanctioned law (the bill is still a draft, and yet to even be placed before the Parliament) to be alarming. Along with news of the increasing costs of the project and doubts about how foolproof the technology will be, it is staggering to imagine that something that raises so many concerns is being pushed through without a more serious debate. The lack of formal procedures and open debates makes one wonder how democratic the actual process is.

Conclusion

To conclude, CIS believes that the UID bill threatens the rights of citizens in India, and appeals to the citizen to think critically of its implications and consequences.

Highlights for February 2019

Maharashtra is a state which is rich in diversity in terms of language and culture seen in its various regions such as Konkan, Marathwada, Western Maharashtra, Northern Maharashtra and Vidarbha. Awareness needs to be created to make Wikimedia movement inclusive and diverse in these geographical regions as well as in their social strata. Keeping this in view CIS-A2K conducted five workshops in different parts of the state.
Marathi language department of Goa University has initiated the process to document the culture of Goa on Marathi Wikipedia and Commons. Subodh Kulkarni reports this in a blog entry.
Khetrimayum Monish Singh and Rajiv K. Mishra co-authored a research paper which was presented at the Young Scholars International Conference on “Margins and Connections,” organised by the Special Centre for the Study of North East India, Jawaharlal Nehru University, on February 7-8, 2019.
Following consultations with data protection, civil society, industry and others, during the Cybercrime Convention Committee (T-CY) meeting from 29 November 2018 onwards, the Cybercrime Convention Committee had sought additional contributions regarding the provisional draft text for a Second Additional Protocol to the Budapest Convention on Cybercrime (“Budapest Convention”). Vipul Kharbanda submitted comments on behalf of CIS.
CIS responded to the call for submissions from the UN Special Rapporteur on Freedom of Speech and Expression. The submission was on the Surveillance Industry and Human Rights.
CIS and University of Munich, Germany are co-organizing an event 'Internet Speech: Perspectives on Regulation and Policy' at India Habitat Centre on April 5, 2019.
Akriti Bopanna on behalf of CIS provided comments on the proposed draft of ICANN’s FY20 Operating Plan and Budget along with their Five-Year Operating Plan Update.
Harsh Bajpai, Ambika Tandon, and Amber Sinha have co-authored a case study 'The Future of Work in the Automotive Sector in India'. The case study highlights the impact of technologies such as artificial intelligence, industry 4.0, internet of things, and so on at industry workplace. The case study was edited by Rakhi Sehgal. Manav Mehta provided research assistance.
In a response to the Draft of The Information Technology [Intermediary Guidelines (Amendment) Rules] 2018, CIS examined whether the draft rules meet tests of constitutionality and whether they are consistent with the parent Act. The submission also examined potential harms that may arise from the Rules as they are currently framed and make recommendations to the draft rules that may enable government to meet its objectives while remaining situated within the constitutional ambit.
A UN high-level panel on Digital Cooperation issued a call for inputs that called for responses to various questions. CIS responded to the call for inputs. The response was drafted by Aayush Rathi, Ambika Tandon, Arindrajit Basu and Elonnai Hickok.

Access to Knowledge

Our Access to Knowledge programme currently consists of two projects. The Pervasive Technologies project, conducted under a grant from the International Development Research Centre (IDRC), aims to conduct research on the complex interplay between low-cost pervasive technologies and intellectual property, in order to encourage the proliferation and development of such technologies as a social good. The Wikipedia project, which is under a grant from the Wikimedia Foundation, is for the growth of Indic language communities and projects by designing community collaborations and partnerships that recruit and cultivate new editors and explore innovative approaches to building projects.

As part of the project grant from the Wikimedia Foundation we have reached out to more than 3500 people across India by organizing more than 100 outreach events and catalysed the release of encyclopaedic and other content under the Creative Commons (CC-BY-3.0) license in four Indian languages (21 books in Telugu, 13 in Odia, 4 volumes of encyclopaedia in Konkani and 6 volumes in Kannada, and 1 book on Odia language history in English).

Highlights

We published revised chapters for the states of Mizoram, Dadra and Nagar Haveli, Himachal Pradesh and Haryana, as part of our National Resource Kit project.
In the concluding blog post of a three-part study Ananth Padmanabhan looks at the Indian law in the Copyright Act and the Information Technology Act, and concludes that both those laws restrain courts and private companies from ordering an ISP to block a website for copyright infringement.
Telugu Wikipedia celebrated its 10^th anniversary. An event was co-organized in Vijaywada to celebrate the same.
The second Institute on Internet and Society was held in Pune from February 11 to 17. The proceedings from the workshop are captured in a blog post.
CIS announced an Open Call for Comments for the latest draft of the Privacy Bill, 2013 prepared by Bhairav Acharya.
Forbes India published its “30 Under 30 List”. Pranesh Prakash is featured in the list.
As part of the Making Change Project, Denisse Albornoz wrote a blog post that compares the production behind a performance with the process of storytelling.
Beli gives an introduction to spectrum sharing. The post looks at GSM and CDMA, and touches upon LTE, and how they might share spectrum.

The Centre for Internet & Society (CIS) wishes you a great year ahead and welcomes you to the second issue of its newsletter for the year 2013. In this issue we bring you an overview of our research programs, updates of events organised by us, events we participated in, news and media coverage, and videos of some of our recent events.

Memorial

Rahul Cherian, an expert and policy activist in disability law, intellectual property and technology law passed away due to an illness while on a visit to Goa on February 7, 2013. Rahul was the founder of the Inclusive Planet Centre for Disability and Policy, and a fellow at CIS. He was also a partner at IndoJuris Law Offices in Chennai and was one of the experts who drafted the Treaty for the Visually Impaired currently being negotiated at the World Intellectual Property Organization. The Hindu (February 8, 2013), First Post (February 8, 2013), Legally India (February 7, 2013), and Bar & Bench (February 8, 2013) covered this story. Lawrence Liang wrote an obituary page, A Lightness of Spirit (The Hindu, February 9, 2013) and Nishant Shah wrote a column One For All (Indian Express, February 17, 2013).

CIS organised a memorial function for Rahul Cherian at the TERI, Southern Regional Centre in Bangalore on February 28, 2013.

Accessibility

CIS is doing two projects in partnership with the Hans Foundation. One of this is to create a national resource kit of state-wise laws, policies and programmes on issues relating to persons with disabilities in India and another is for developing a screen reader and text-to- speech synthesizer for Indian languages. CIS is also working with the World Blind Union and many other organisations to develop a Treaty for the Visually Impaired helped by the WIPO:

National Resource Kit for Persons with Disabilities

Anandhi Viswanathan from CIS and Manojna Yeluri from the Centre for Law and Policy Research are working in this project. Draft chapters have been published. Feedback and comments are invited from readers for the chapters on Bihar and West Bengal:

The Bihar Chapter (by Manojna Yeluri, February 14, 2013): The state of Bihar is in the process of formulating a comprehensive state policy on disability. The Bihar State Policy on Disability is an extension of the National Policy for Persons with Disabilities and is currently in a draft form awaiting government approval and notification.
The West Bengal Chapter (by Anandhi Viswanathan, February 28, 2013): The state of West Bengal has issued the West Bengal Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1999 to implement the provisions under the central Persons with Disabilities (Protection of Rights, Equal Opportunities and Full Participation) Act, 1995.

Access to Knowledge

The Wikimedia Foundation awarded CIS a two year grant of INR 26,000,000 to support and develop the growth of Indic language communities and projects by community collaborations and partnerships. This is being carried out by the Access to Knowledge team based in Delhi. CIS is also doing a project (Pervasive Technologies) on examining the relationship between production of pervasive technologies and intellectual property. The project researches upon the noteworthy opportunities of the new types of low cost mobile devices, content and services as available in the market.

Wikipedia

Beginning from September 1, 2012, Wikimedia Foundation awarded CIS a two-year grant of INR 26,000,000 to support and develop free knowledge in India. The A2K team consists of four members based in Delhi: T. Vishnu Vardhan, Nitika Tandon, Subhashish Panigrahi and Noopur Raval, and one new team member Dr. U.B. Pavanaja who works from Bangalore office.

New Team Member

Dr. U.B. Pavanaja joined the A2K team as Programme Officer, India Language Initiatives on February 19, 2013. Dr. Pavanaja holds a Master’s degree from Mysore University and Ph.D. from Mumbai University. He was a scientist at Bhabha Atomic Research Centre, Mumbai, for about 15 years. He is one of the earliest editors of Kannada Wikipedia. He has to his credit many firsts, viz., first Kannada website, first Kannada online magazine, first Indian language (Kannada) website to receive Golden Web Award, first Indian language (Kannada) editor for Palm OS, first Indian language (Kannada) editor for WinCE device (HP Jornado 720), first Indian language version (Kannada) of universally popular Logo (programming language for children) software, etc. His Kannada logo won the Manthan Award for the year 2006. He was a member of the technical advisory committee setup by the Govt. of Karnataka for Standardization of Kannada on Computers (2000). He is also a member of the Kannada Software Committee of Govt. of Karnataka (2008-current).

Internet Access – Knowledge Repository

CIS in partnership with the Ford Foundation was executing the telecom knowledge repository project which included producing and disseminating modules on various aspects of telecommunications including policy, regulations, infrastructure and market. However, from November 2012 there was a change in the mandate of the project. The new repository will cover the history of the internet, technologies involved, principle and values of internet access, broadband market and universal access. It will also touch upon various polices and regulations which has an impact on internet access and bodies and mechanism which are responsible for formulation policies related to internet access. The blog posts and modules will be published in a new website: www.internet-institute.in.

Upcoming Event

We are hosting an “Institute on Internet and Society” in collaboration with the Ford Foundation India, which is to be held from June 8, 2013 to June 14, 2013. Call for registration and relevant details will be announced soon on our website.

Telecom

While the potential for growth and returns exist for telecommunications in India, a range of issues need to be addressed. From 2012 to 2015, the Researchers At Work series is focusing on building research clusters in the field of Digital Humanities. We organised the first Habits of Living workshops in Bangalore last year. The next workshop is being held in Brown University.

CIS was registered as a society in Bangalore in 2008. As an independent, non-profit research organisation, it runs different policy research programmes such as Accessibility, Access to Knowledge, Openness, Internet Governance, and Telecom. The policy research programmes have resulted in outputs such as the e-Accessibility Policy Handbook for Persons with Disabilities with ITU and G3ict, and Digital Alternatives with a Cause?, Thinkathon Position Papers and the Digital Natives with a Cause? Our Policy Director, Nirmita Narasimhan won the National Award for Empowerment of Persons with Disabilities from the Government of India and also received the NIVH Excellence Award.

Accessibility

Around 70 million disabled persons in India are unable to participate in information societies as lack of compliance with accessibility standards make interfaces impossible to use, and retrograde copyright and patent policies make it impossible to access knowledge. Accessibility is denied in banking services, web and mobile interfaces, etc. Material for the disabled therefore needs to be converted into accessible formats. The programme has resulted in outputs such as Web Accessibility Policy Making, Making Mobile Phones and Services Accessible for Persons with Disabilities, Accessibility Policy Making: An International Perspective, e-Accessibility Policy Handbook for Persons with Disabilities, Universal Service for Persons with Disabilities: A Global Survey of Policy Interventions and Good Practices, etc.

Web Accessibility Policy Making: An International Perspective: G3ict and the Centre for Internet and Society are pleased to announce the publication of a new, improved edition of the Web Accessibility Policy Making: An International Perspective. The report published in cooperation with the Hans Foundation provides an updated synopsis of the many policies that governments have implemented around the world to ensure that the Internet and websites are accessible to persons with disabilities.

Event

ITU Tutorial on Audiovisual Media Accessibility (India International Centre,New Delhi, March 14 to 15, 2012): At the invitation of the Centre for Internet and Society, in cooperation with the ITU-APT Foundation of India, International Telecommunication Union is organizing a two-day Tutorial on Audio Visual Media Accessibility. The Tutorial will be preceded by the fourth meeting of the Focus Group on Audio Visual Media Accessibility on March 13, 2012. The meeting will take place in the same venue and will be hosted by the Centre for Internet and Society in cooperation with the ITU-APT Foundation of India.

Access to Knowledge

With the emergence of digital technologies and the unprecedented growth of the Internet and other related technologies, intellectual property rights (IPRs) the questions of ownership and control of information have become crucial. The programme focuses on the inequitable distribution of IPR, royalty, outflows, and beneficiaries of intellectual property regimes, the lack of balance in current IPR regimes [local, national and international] between consumer rights and IPR-owners’/corporation’s rights. The programme has produced analyses such as WIPO Treaty for the Print Disabled, WIPO Broadcast Treaty, Copyright Amendment Bill and Parallel Importation of Books.

Openness

The advent of the Internet has radically defined what it means to be open and collaborative. Even the Internet is built upon open standards and free/libre/open source software. The broad rubric of the ‘Openness’ programme focuses to provide evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international policies and practices around Open Government Data, Open Access to Scholarly Literature, Open Access to Law, Open Content, Open Video, Open Standards and Free/Libre/Open Source Software. The programme has resulted in reports such as Open Government Data Study, Online Video Environment in India, a reader on the Wikipedia titled Critical Point of View: A Wikipedia Reader and a film titled People are Knowledge – Experimenting with Oral Citations on Wikipedia.

Internet Governance

Governments and private corporations are engaging in human rights violations online. Many different rights are impacted by internet governance policy changes. The growing phenomenon of illegal electronic surveillance by state and non-state actors and censorship of speech online are some specific problems that the Internet Governance programme seeks to address by providing evidence based research that will help inform policy and practice of the local, national, regional, bilateral and international privacy regime in the interests of the public in sectors key to information societies with a particular focus on information technology, privacy and freedom of expression. The programme has resulted in outputs such as Banking, Telecommunications, Consumer Protection, IT Act, Limitations, Copyright, Internet Protocol, Media, Sexual Minorities, UID and policy submissions such as, NIA Bill, IT Act, National Policy on Electronics, Cyber Café Rules, Security Practices Rules, and Intermediary Due Diligence Rules.

All India Privacy Symposium: (India International Centre, New Delhi, February 4, 2012): Experts gathered in Delhi for a public symposium on privacy, transparency, e-governance and national security in India. The event was organized by Privacy India in partnership with the International Development Research Centre, Canada, Privacy International, UK, Commonwealth Human Rights Initiative and Society in Action Group, Gurgaon. Telecom

The growth in telecommunications in India has been impressive. While the potential for growth and returns exist, a range of issues need to be addressed for this potential to be realized. One aspect is more extensive rural coverage and the second aspect is a countrywide access to broadband which is low at about eight million subscriptions. Both require effective and efficient use of networks and resources, including spectrum. The programme has resulted in reports such as India's untapped potential: Are a billion people losing out because of spectrum?, India Study Tour - Report: The South African Telecommunications Sector: Poised for Change and the Unlicensed Spectrum-Policy Brief for Government of India NTP '11.

Unlicensed Spectrum-Policy Brief for Government of India NTP '11 by Satyen Gupta, Sunil Abraham and Yelena Gyulkhandanyan: The research paper aims to recommend unlicensed spectrum policy to the Government of India based on recent developments in wireless technology, community needs and international best practices, and seeks to demonstrate the need for and importance of unlicensed spectrum as a medium for inexpensive connectivity in rural/remote areas, as well as catalyzing innovation by being a barrier-free and cost-effective platform for the testing and implementing of new technologies.

Digital Natives with a Cause?

Digital Natives with a Cause? is a knowledge programme initiated by the Centre for Internet and Society, India and Hivos, Netherlands. It is a research inquiry that seeks to look at the changing landscape of social change and political participation and the role that young people play through digital and internet technologies, in emerging information societies. The programme has resulted in a four-book collective titled Digital AlterNatives with a Cause? and reports such as Digital Natives with a Cause? A Report and Digital Natives with a Cause? Thinkathon: Position Papers.

Digital Natives Video Contest: Twenty-one candidates have been shortlisted, videos will be online soon. Voting begins from March 10, 2012. The Centre for Internet and Society is co-organising the video contest with Hivos, Netherlands.

RAW is a multidisciplinary research initiative. CIS believes that in order to understand the contemporary concerns in the field of Internet and society, it is necessary to produce local and contextual accounts of the interaction between the Internet and socio-cultural and geo-political structures. To build original research knowledge base, the RAW programme has been collaborating with different organisations and individuals to focus on its three year thematic of Histories of the Internets in India. Estimates of the percentage of the world's population that is disabled vary considerably. But what is certain is that if we count functional disability, then a large proportion of the world's population is disabled in one way or another. At CIS we work to ensure that the digital technologies, which empower disabled people and provide them with independence, are allowed to do so in practice and by the law. To this end, we support web accessibility guidelines, and change in copyright laws that currently disempower the persons with disabilities.

Internet Governance

Although there may not be one centralised authority that rules the Internet, the Internet does not just run by its own volition: for it to operate in a stable and reliable manner, there needs to be in place infrastructure, a functional domain name system, ways to curtail cyber crime across borders, etc. The Tunis Agenda of the second World Summit on the Information Society (WSIS), paragraph 34 defined Internet governance as “the development and application by governments, the private sector and civil society, in their respective roles, of shared principles, norms, rules, decision-making procedures, and programmes that shape the evolution and use of the Internet.” CIS involvement in the field of Internet governance has taken the following shape:

CIS is doing a project, ‘Privacy in Asia’. It is funded by Privacy International (PI), UK and the International Development Research Centre, Canada and is being administered in collaboration with the Society and Action Group, Gurgaon. The two-year project commenced on 24^th March 2010 and will be completed as agreed to by the stakeholders. It was set up with the objective of raising awareness, sparking civil action and promoting democratic dialogue around challenges and violations of privacy in India. In furtherance of these goals it aims to draft and promote over-arching privacy legislation in India by drawing upon legal and academic resources and consultations with the public.

February 11: The Day We Fight Back Against Mass Surveillance

The expansive surveillance being perpetuated by governments and corporations is the single biggest threat to individual liberties in the digital age.

The expanding scope and extent of massive data collection and surveillance undertaken by bodies like the USA’s National Security Agency compromises our privacy and stifles our freedom of speech and expression in its most vital public spheres, affecting the civil liberties of citizens of countries all across the world.

The previous year has been a watershed year for reclaiming the internet as a free and open space, primarily through the exposure of the unwarranted systems of surveillance that threaten it, by whistle-blowers like Edward Snowden and WikiLeaks. Despite all these efforts, they have only managed a dent in the surveillance regimes, which continue unbridled, with the protection of the state and the surveillance industry. The future of a free internet depends upon the systematic challenge of these programs by the millions of internet users they affect.

February 11, 2014 is the day we fight back against mass surveillance. Organized by the Electronic Frontier Foundation, and supported by thousand of organizations like Mozilla and the Centre for Internet and Society, on this day of action, citizens around the world will demand an end to these programs that threaten the freedom of the internet. You can support this cause by signing and supporting the 13 Principles (International Principles on the Application of Human Rights to Communications Surveillance), and contacting your local media, petitioning your local legislators and telling your friends and colleagues about the topic. Publicizing the movement and creating a buzz around it will help spread the message to many others across the internet. Do anything that will make the fight more visible and viable, such as organizing or attending public lectures, or creating tools or memes or art to spread information. For more ways in which you can contribute, and more information on the event, visit the website.

The users of the internet deserve a free and open internet and deserve and end to mass surveillance. If we can make enough noise, make enough of an impact, we can greatly bolster the movement for reclaiming the internet.

Fear, Uncertainty and Doubt

Much confusion has resulted from the Section 66A verdict. Some people are convinced that online speech is now without any reasonable restrictions under Article 19 (2) of the Constitution. This is completely false.

There are many other provisions within the IT Act that still regulate speech online, for example the section on obscenity (Sec. 67) and also the data protection provision (Sec. 43A). Additionally there are provisions within the Indian Penal Code and other Acts that regulate speech both online and offline. For example, defamation remains a criminal offence under the IPC (Sec. 499), and disclosing information about children in a manner that lowers their reputation or infringes their privacy is also prohibited under the Protection of Children from Sexual Offences Act, 2012 (Sec. 23).

Others are afraid that the striking down of Section 66A results in a regulatory vacuum where it will be possible for bad actors to wreak havoc online because the following has been left unaddressed by the IT Act.

Criminal Intimidation: The phrase "criminal intimidation" was included in Sec. 66A(b), but the requirement was that intimidation should be carried out using "information which he knows to be false". Sec. 506 of the IPC which punishes criminal intimidation does not have this requirement and is therefore a better legal route for affected individuals, even though the maximum punishment is a year shorter than the three years possible under the IT Act.
Cyber-stalking: A new section for stalking - Sec. 345 D - was added into the IPC in 2013 which also recognised cyber stalking. The definition within Sec.345D is more precise compared to the nebulous phrasing in Sec. 66A, which read - "monitors the use by a woman of the internet, email or any other form of electronic communication, commits the offence of stalking".
Phishing: Sec. 66A (c) dealt with punishment to people who "deceive or mislead the addressee or recipient about the origin of such messages". Sec.66D, which will be the operative section after this verdict, deals with "cheating by impersonation" and forms a more effective safeguard against phishing.

Cyber-bulling of children is arguably left unaddressed. Most importantly, spam, the original intention behind 66A, now cannot be tackled using any existing provision of the law. However, the poorly drafted section made it impossible for law enforcement to crack down on spammers. A 2005 attempt by the ITU to produce model law for spam based on a comparative analysis of national laws resulted in several important best practices that were ignored during the 2008 Amendment of the Act. For example, the definition of spam must cover the following characteristics - mass, unsolicited and commercial. All of which was missing in 66A.

Good quality law must be drafted by an open, participatory process where all relevant stakeholders are consulted and responded to before bills are introduced in parliament.

FCC’s plan to repeal net neutrality may not impact India

India is unlikely to be impacted by the US Federal Communications Commission’s plan to repeal net neutrality regulations.

India adopted a pro-net neutrality stand by taking a tough call against zero-rated plans such as Facebook’s Free Basics and Airtel Zero last year. According to experts, the Indian telecom regulator showed great courage and conviction by battling any type of preferential treatment of internet websites. This was even after a massive campaign by Facebook in support of its Free Basics programme, which promised access to a few basic services free of cost through partnerships with selected telecom service providers.

“Our regulator now thinks of itself as a forerunner in this space, so we doubt they are going to be influenced by the American move,” said Sunil Abraham, Executive Director of the Centre for Internet and Society in Bengaluru. He called the proposal to withdraw the President Barack Obama era regulations “incredible” since they took almost a decade and lots of debate to be framed. Abraham said there is no evidence to suggest that India copies what the US does and there is a long way to go before the new regulations come in.

“The FCC is just one actor in this game — there are the Congress and the courts along with the Federal Trade Commission,” said Abraham, adding that the proposal is likely to be challenged at multiple levels. “I’m proposing to repeal the heavy-handed Internet regulations imposed by the Obama Administration and to return to the light-touch framework under which the Internet developed and thrived before 2015,” FCC chief Ajit Pai, who worked for Verizon Communications earlier, tweeted on Tuesday. The plan shared by Pai will be put to vote on December 14. Experts expect the plan to go through, given the Republican majority in the FCC and they fear it will allow internet service providers like Verizon, AT&T and Comcast to give preference to some sites and apps in return for a fee or for their own business interests.

“If it goes through, it will take control away from the user and companies will be free to make fast lanes and favour the content they like and play the gatekeepers,” said Mishi Choudhary, president at Software Freedom Law Centre.

She said the conversation has once again moved the power back to internet service providers, which will hurt small companies on the pretext of innovation and getting away from micro managing. “It is certainly not bolstering the position of the US as a leader for free and open internet,” added Choudhary. Streaming service Netflix tweeted in response saying that it supports strong net neutrality and opposes the FCC’s proposal.

The Telecom Regulatory Authority of India (Trai) fought a tough battle in 2016 against plans that promised select internet services to poor people by offering them free of cost. The regulator issued differential pricing regulations by which it banned what’s known as zerorating plans. “Trai showed immense foresight by releasing the rules and this is a good opportunity for India to occupy the vacuum of leadership in this space by providing the right regulatory environment,” said Choudhary.

FB & Google have already monopolised Indian cyberspace

In an interview with Catch, Sunil Abraham, executive director of Center for Internet & Society, puts the recent US-India cyber relationship framework into perspective. Abraham also talks about how Indian surveillance policies are outdated and why the country has failed to check the hegemonic tendencies of companies like Facebook and Google.

US-India signed a cyber relationship framework earlier this month. Could you explain some of the takeouts that may have important implications in the near future?

In the framework, both sides have made a "commitment to the multi-stakeholder model of Internet governance" - in immediate practical terms that means India will accept the Internet Assigned Numbers Authority (IANA) transition proposed for the Internet Corporation for Assigned Names and Numbers (ICANN). Unfortunately, as my colleague Pranesh Prakash points out "U.S. state control over the core of the internet's domain name system is not being removed by the transition that is currently underway."

India along with Brazil and other emerging powers should have insisted that the question of jurisdiction be addressed before the transition. We must remember, that the multi-stakeholder model is just a fancy name for open and participatory self-regulation by the private sector. While the multi-stakeholder model is useful as a complement to traditional state-led regulation, it cannot be used to protect human rights or ensure the security of a nation state.

[That is precisely why - the very next sentence in the announcement for the the framework for the US-India Cyber Relationship says "a recognition of the leading role for governments in cyber security matters relating to national security". This is because ICANN-style multistakeholderism requires all stakeholders to be on "equal footing" without "distinct roles and responsibilities". In other words, the governments are saying that the multistakeholder model is fine for all Internet Governance areas with the exception of Cyber Security. Given the limits of the multistakeholder model this is indeed the wise thing to do. Since American corporations dominate the Internet, US foreign policy has historically pushed for the multistakeholder model as fig leaf for forbearance and reduced foreign regulatory burden American corporations operating in other jurisdictions. Therefore India must not drink the multistakeholder cool-aid whole sale. It cannot afford a laissez-faire approach where it waits for corporations to self-regulate - it must regulate whenever public interest or human rights are harmed. In other words, it must go beyond the multistakeholder model and produce appropriate regulation where necessary. Needless to add - it must also deregulate in areas where harms don't exist. Apart from this many of the details of the announcement are positive steps that will increase security in India and the USA, and indeed the also across the world.]

What are some aspects of Intellectual Property Rights that should be looked at, in the context of the framework?

There is some language around Intellectual Property Rights (IPR) that should be examined carefully too. The US corporations benefit from a maximalist IP regime. But Make in India, Digital India and Startup India all depend on flexibilities to the IP regime and therefore India should refuse signing. Trans-Pacific Partnership (TPP) obligations like the "Digital 2 Dozen" which the US is actively proselytizing across the Pacific. If we make that mistake, we will make zero progress in indigenous security research and product development and also many other areas of our economy, health sector and education sector will be severely compromised. Therefore it would be best to keep IP rights expansion and enforcement out of the framework for the US-India Cyber Relationship.

The PIL seeking a ban on WhatsApp was refused by the SC recently. Encrypted messaging services like Telegram however, have been used in the past by terror groups. What's your take on such end-to-end encryption services?

Privacy and security are two sides of the same coin. You cannot have one without the other. End-to-end encryption is the basis for online privacy. End-to-end encryption is a pre-requisite for many legitimate actions of law abiding citizens online such as commerce, banking, tele-medicine, protection of intellectual property, witness/source protection, client confidentiality etc. Therefore, banning end-to-end encryption would mean the death of individual privacy and national security.

If the government wants to promote cyber security it should promote the use of end-to-end encryption amongst law abiding citizens.

Terrorist have to be stopped through targeted profiling, surveillance and interception. Big data analytics may be useful to watch for patterns in the meta data but there is no replacement for good old fashioned police work.

Once suspects have been identified the encrypted channels can be compromised by:

Placing trojans on the end-user devices
Performing man-in-the-middle attacks and
Using brute force attacks with super computers.

Snowden's revelations have made it very clear that blanket and mass surveillance does not help foil terror attacks or stop organised crime. So far, research and government reports from across the world indicate that only a minority of terrorists use encryption. However, this situation may change.

We don't have any proper encryption policy under the IT Act yet. What's taking so long and what are the key points that any policy in this matter must include in future?

We need many different types of encryption policies. We need a policy that mandates encryption and digital signature for all government personnel and also for all government transactions. We need policies that promote research and development in cryptography and mathematics. We need to update our criminal procedure code so that encrypted communications and data can be targeted by law enforcement and used effectively in the criminal justice process.

However, we should not have any broad encryption policy that tries to regulate encryption as a technology. That would be a highly regressive move and will be impossible to enforce. That would breed contempt for rule of law.

Surveillance and the tech around it has been contentious for various governments. Where do we stand vis-a-vis regulating surveillance measures by the state?

Our surveillance and interception laws are outdated. They need to be modernized to deal with advancements in technology and also global developments when it comes to data protection and privacy law.

In fact, our organisation was part of a global effort called Necessary and Proportionate which identified 13 principles to modernise surveillance which are connected to various aspects such as Legality, Legitimate aim, Competent judicial authority, Integrity of communications and systems and more. Some of these principles may have to be customised for the Indian context. [For example, given the load on courts perhaps India should stay with executive authorization of interceptions and data access requests. However, getting the law correct is only half the job. For the law cannot fix what the technology has broken. Some surveillance projects are well designed. For ex. the NATGRID - from what I understand it is a standard and platform that which will allow 12 security, intelligence and law enforcement agencies to temporarily make unions of sub-sets of 21 data sources. These automated temporary databases will be created under existing data access provisions of the law. I also hope the NATGRID is also using cryptography to ensure the maintenance of a non-repudiable log that will identify all officers involved in authorizing the each request and accessing the resultant data. Unfortunately, other surveillance projects are unmitigated disasters. For example, UID or Aadhaar. Many Indians don't realize that Aadhaar is a surveillance project. Biometrics is just a fancy name for remote, covert and non-consensual identification technology. Using the UID database the government can identify every single Indian without their consent. The so called "consent layer" in the India Stack is being developed by volunteers outside the UIDAI to avoid transparency under the Right to Information Act. Nothing in the current layer of the "consent layer" allows citizens to revoke consent. There is no facility in the UID Act to delete yourself from the database. Identity information aka the UID number and authentication information aka your biometrics for about a billion Indians have been collected and stored in a centralized location. It is as if our parliamentarians have written an open letter to criminals and foreign governments says "here is the information you need to wreck whole sale damage - come and get it". Hopefully the Supreme Court will save us from this impending disaster.]

With a sluggish US market, India has the biggest potential for companies like FB & Google, next only to China. Do you feel that in the quest to take over the Indian market, FB & Google are going to monopolise cyberspace in India?

I have news for you - they have already monopolised Indian cyberspace. They have completely wiped out competition in certain domains.

One of the many reasons they have done this is because we don't have laws and regulations to temper their hegemonic tendencies. For example, we could use data portability and interoperability mandates for social media to spark competition in markets where there are entrenched monopolies.

Competition law can be used to protect other firms from abuse of market power. Consumer protection law and privacy law could be used to ensure that user's rights are not compromised in the race for market share. In addition, a modern privacy law compliant with the best practices in the European Data Protection Regulation 2016, would allow emerging Indian companies to compete with giants like Facebook and Google on a level playing field. [Speaking of level playing field - only recently has the government introduced the "equalization levy". This was long overdue. Imagine the amount of tax that could have been collected so far and damage that has been done to competition. Regardless the current NDA government deserves our kudos for ensuring that Facebook and Google contribute their fair share of taxes. The new IPR Policy was also an opportunity to address the monopoly of Google and Facebook. There should have been a concerted attempt to use free/open source software, open standard and open content to bolster Indic language technologies. A billion dollars from every spectrum auction should be used to create incentives for Indian private sector, research and academic organisation who can contribute openly to the Indic cyberspace. This is the market where we can still build a highly competitive market. Today, given government inaction - millions of Indians are training Google's language platforms every time they use machine translation or speech to text technologies. This corpus of information will not be available for public interest research. Ideally we should also have Indians contributing to commons-based peer production projects like Wikipedia for their Indic language needs. Unfortunately the government totally missed this opportunity.]
